Intergovernmental Relations Manager Ginna Carico introduced Legislative District 23 Representative Mariana Sandoval who presented the legislative proclamation to Chief Rodriguez. 

Council thanked Chief Rodriguez for his service, dedication and commitment to the Goodyear community.

AMEND ARTICLE 3-9 PUBLIC AND PERFORMING ARTS ORDINANCE
 
RECOMMENDATION
ADOPT ORDINANCE NO. 2024-1611 AMENDING CHAPTER 3 ARTICLE 9, PUBLIC AND PERFORMING ARTS PROGRAM, OF THE GOODYEAR CITY CODE, PROVIDING FOR CORRECTIONS, SEVERABILITY AND AN EFFECTIVE DATE. (Layne Ruiz, Arts & Culture Coordinator)
In response to Council inquiry, City Attorney Roric Massey confirmed that the Ordinance removes the requirement for a member of the West Valley Arts Council to serve on the Arts and Culture Commission.

MUNICIPAL SPONSORSHIP FOR 2024 AK-CHIN INDIAN COMMUNITY REVENUE SHARING GRANT PROPOSAL
 
RECOMMENDATION
ADOPT RESOLUTION NO. 2024-2416 SUPPORTING THE SUBMISSION OF A 2024 AK-CHIN INDIAN COMMUNITY GRANT APPLICATION BY SOLID ROCK FOUNDATION, AND AUTHORIZING THE CITY MANAGER TO ACCEPT AND ADMINISTER SUBSEQUENT AWARDED FUNDS, AND ANY AMENDMENTS THERETO, AS A PASS-THROUGH GRANT. 6.
GRANT OF AN AERIAL UTILITY LINE EASEMENT TO APS, OVER A PORTION OF CITY-OWNED PROPERTY AT THE NORTHWEST CORNER OF VAN BUREN STREET AND 143RD AVENUE
 
RECOMMENDATION
Approve the Aerial Utility Line Easement granting APS an aerial easement above a portion of the City Parcel approximately located at the northwest corner of Van Buren Street & 143rd Avenue and authorize its execution by the City Manager following the City’s receipt of APS’s payment of $6,475. (Kimberly Romero SR/WA, Real Estate Coordinator).
 
7.
DEDICATION OF RIGHT-OF-WAY FOR ADDITIONAL PARKING ALONG N. CIVIC SQUARE AND PARTIAL TERMINATION OF AN EXISTING SIDEWALK EASEMENT LOCATED WITHIN RIGHT-OF-WAY BEING DEDICATED
 
RECOMMENDATION
Accept the dedication of the Right-of-Way from Globe Land Investors LLC, approve the Partial Termination and Release of Easement, and authorize the execution of both documents by the City Manager. (Colton Blyle, Real Estate Specialist)
 
8.
EL CIDRO - 175TH AVE AND ELWOOD ST – ABANDONMENT
 
RECOMMENDATION
1. ADOPT RESOLUTION NO. 2024-2414 DECLARING SECTIONS OF 175th AVENUE AND ELWOOD STREET UNNECESSARY FOR PUBLIC ROADWAY AND EXTINGUISHING THE RIGHT OF WAY EASEMENT GRANTING THE CITY THE UNNECESSARY PUBLIC ROADWAY; PROVIDING FOR THE RECORDATION OF THIS RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATES OF THE EASEMENT EXTINGUISHMENT AND THE RESOLUTION.

2. ADOPT RESOLUTION NO. 2024-2415 DECLARING SECTIONS OF 175th AVENUE AND ELWOOD STREET UNNECESSARY FOR PUBLIC ROADWAY AND VACATING THE ROADWAY; PROVIDING FOR THE RECORDATION OF THE RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATES OF THE ABANDONMENT AND THE RESOLUTION. (Marty Crossland, Deputy Director of Development Engineering).
 
9.
ACQUISITION OF RIGHT-OF-WAY FOR SARIVAL AVENUE IMPROVEMENTS
 
RECOMMENDATION
ADOPT RESOLUTION NO. 2024-2411 APPROVING AGREEMENTS RELATED TO THE CITY’S ACQUISITION OF RIGHT-OF-WAY FROM ADOT, PROVIDING CONDITIONS FOR THE EXECUTION OF THE AGREEMENTS, PROVIDING FOR AUTHORIZATION, DIRECTION, AND AN EFFECTIVE DATE. (Kimberly Romero, Real Estate Coordinator)
Councilmember Campbell expressed concerns with supporting Liberty's water reclamation facility without specific start and end dates for roadwork.

In response to Council inquiry regarding Items 10 through 17, Director of Development Services Katie Wilken clarified that these parcels are interdependent for infrastructure and access and needed to be approved together.

18.
WEST VALLEY CHRISTIAN SCHOOL EXPANSION
Mayor Pizzillo opened the public hearing at 5:28 p.m.

Director of Development Services Katie Wilken presented the request for a special use permit and highlighted the site location, surrounding areas and the property's zoning history. She discussed the proposal which includes the addition of a classroom building, an additional parking lot and driveway and outdoor storage containers. She noted that 20 people were in attendance at the Neighborhood Meeting and raised concerns about traffic. To address these concerns, Ms. Wilken explained that the applicant proposed adding an access drive that would connect to 161st Avenue to provide single-family homes an alternative route to avoid school traffic congestion. Ms. Wilken further explained that the applicant is permitted to make improvements but cannot expand their services without obtaining a special use permit from the city. 

Dolly Ortiz, Goodyear resident, requested a block wall be installed along 161st Lane. 

Mayor Pizzillo closed the public hearing at 5:37 p.m.

In response to Council inquiry, Ms. Wilken clarified that the stipulations in the special use permit do not apply to public or charter schools if the property is sold in the future. To address traffic concerns, she explained that queuing is not permitted on Van Buren Street and that the traffic study allows stacking up to 59 cars on 161st Lane. Ms. Wilken added that the applicant is required to limit access to the single-family homes on the access drive by visitors to the church school. 

Council discussed recording an easement on the new access road, the addition of a block wall and including the gates as part of the stipulations. Council also discussed the type and maintenance of the gates to be installed. 

Jerry Patton, representing the applicant, responded to various Council inquiries. He confirmed that the applicant will provide a manual fire emergency access gate with a dual lock system. He suggested adding signage for private road use and addressed that the school has no intention of using the access road. He also stated that development of future lots would go through the site plan approval process. 

In response to Council inquiry, City Attorney Roric Massey confirmed that a recorded easement for the access road would remain with the property. 
 

MOTION BY Councilmember Wally Campbell, SECONDED BY Councilmember Brannon Hampton to APPROVE the request for a Special Use Permit for a private school expansion on property zoned Agricultural Urban (AU) and Commercial Office (CO) on approximately 16.45-acres property, approximately located at the northeast corner of Sarival Avenue and Van Buren Street, subject to stipulations. The motion carried as follows:

19.
AUTHORIZATION OF BUDGET AMENDMENT AND CONTRACT FOR THE EXPENDITURE OF CONSTRUCTION AND FF&E FUNDS FOR APPROVED CIP PROJECT #60122 – GMC TENANT IMPROVEMENTS BUILDING B
Director of Engineering Steve Scinto provided an update on the Goodyear Municipal Complex Tenant Improvements. He discussed the changes to the original scope of the project, as well as the increased construction costs and off-hours contractor fees. 
 

MOTION BY Vice Mayor Laura Kaino, SECONDED BY Councilmember Sheri Lauritano to AUTHORIZE the budget amendment of $2,481,000 and contract for the expenditure of construction and furniture, fixtures, and equipment (FF&E) funds up to $1,920,000 for Capital Improvement Program (CIP) Project #60122 – Goodyear Municipal Complex (GMC) Tenant Improvements Building B. The motion carried as follows:

20.
PRIMARY AND SECONDARY PROPERTY TAX LEVIES FOR FY2025
Finance Manager Ryan Bittle highlighted the FY2025 budget outreach process, and stated that $15,140,885 will be generated from the primary property tax levy to support ongoing General Fund operations and $13,237,000 will be generated from the secondary property tax levy to pay debt service on voter approved General Obligation bond debt. He added that the rate of $1.73 per $100 of assessed valuation has remained unchanged since 2018.

In response to Council inquiry, Mr. Bittle clarified that the city's share of property tax fluctuates annually and is approximately 15% of the total property tax bill. 
 

MOTION BY Councilmember Vicki Gillis, SECONDED BY Councilmember Brannon Hampton to ADOPT ORDINANCE NO. 2024-1612 LEVYING UPON THE ASSESSED VALUATION OF THE PROPERTY WITHIN THE CITY OF GOODYEAR, SUBJECT TO PRIMARY AND SECONDARY TAXATION A CERTAIN SUM UPON EACH ONE HUNDRED DOLLARS ($100.00) OF VALUATION SUFFICIENT TO RAISE THE AMOUNTS ESTIMATED TO BE REQUIRED IN THE ANNUAL BUDGET FOR THE PURPOSE OF PAYING FOR VARIOUS EXPENSES; TO RAISE THE AMOUNT ESTIMATED TO BE RECEIVED FROM OTHER SOURCES OF REVENUES; PROVIDING FUNDS FOR VARIOUS BOND REDEMPTIONS, FOR THE PURPOSE OF PAYING PRINCIPAL AND INTEREST UPON BONDED INDEBTEDNESS; ALL FOR FISCAL YEAR ENDING THE 30TH DAY OF JUNE 2025 AND DIRECTING THE CITY CLERK TO RECORD A COPY OF THIS ORDINANCE. The motion carried as follows:

INFORMATION ITEMS
Councilmember Lauritano expressed appreciation for the Goodyear Fire Department Camp F.I.R.E.S program.

Vice Mayor Kaino highlighted the city's Juneteenth Family Day event held at the Goodyear Recreation Campus. City Manager Wynette Reed reported that approximately 4,000 people were in attendance. She recognized the various departments for their efforts in organizing the event.

City Manager Wynette Reed recognized Chris Virgo, Goodyear Telecommunications Supervisor, who received the 2023 Arizona Association of Public Safety Communications Officials/National Emergency Number Association Supervisor of the Year Award. She also recognized Shauna Henrie, Telecommunications Manager, Ed Pahl, Deputy Fire Chief, and Jasmine Pernicano, Deputy City Clerk, for graduating from Arizona State University's Certified Public Manager Program.
