Presentation, Discussion, and Appropriate Action on Whether to Permit Kenneth Heng to Convert his Accidental Disability Application to an Ordinary Disability Application.
The Board entered into Executive Session at 8:30 a.m.
Chair Kano reconvened the Fire Public Safety Personnel Retirement Board meeting at 9:41 a.m.
Board Attorney Sorensen reviewed the options available to the Board which included the following:
1. Deny the Motion to Convert
2. Approve the Motion to Convert and approve the ordinary disability pending receipt of additional information from Dr. Farber.
3. Approve the Motion to Convert and schedule a future meeting for the consideration of the ordinary disability requirements including additional information from Dr. Farber.
4. Approve the Motion to Convert and schedule a future meeting for consideration of the ordinary disability requirements, including additional information from Dr. Farber and whether A.R.S.§38-844(D)(2) applies.

Review, discussion and possible action on the reemployment of Kenneth Heng.
Vice Chair Mathias said having reviewed the information presented, he recommended the Board find that Kenneth Heng satisfies the requirements of §38-849(E)(3)(c) because Kenneth Heng accepted a job reassignment as an accommodation in accordance with the ADA due to a disability that was directly related to the disability for which Kenneth Heng is receiving a benefit. Further, having reviewed the job description, the alternate contribution rate is not required because the position of Administrative Assistant is NOT ordinarily filled by a contributing PSPRS member. There was consensus for the finding.

Per ARS §38-431.03, upon a public majority vote of the members constituting a quorum, the Goodyear Fire Public Safety Personnel Retirement Board may hold an executive session for any item on the agenda.
