Chairman Clymer called the meeting to order at 6:15 p.m.

MOTION BY Boardmember Teri Roberts, SECONDED BY Boardmember Monica Lee to EXCUSE Board member McLendon from the meeting. The motion carried by the following vote:

APPROVAL OF MINUTES
 

MOTION BY Vice Chair Kent Hegedus, SECONDED BY Boardmember Teri Roberts to APPROVE the draft minutes of the Board of Adjustment meeting held on March 8, 2023. The motion carried by the following vote:

AMENDMENT TO THE BOARD OF ADJUSTMENT RULES OF PROCEDURE
Staff presented proposed amendments to the Rules of Procedure for the Board of Adjustment. The current Rules of Procedure were adopted on January 10, 1996, and have not been updated since that time. Periodic updates are necessary to ensure the Rules remain consistent with current state statutes, local ordinances, and best practices for quasi-judicial boards.

Key amendments include:
  • Improvements to clarity, consistency, and overall modernization.
  • Guidelines for the Planning & Zoning Commission serving as the Board of Adjustment.
  • Expanded Chair authorities, including provisions allowing the Chair to set reasonable time limits, define the issues to be addressed during hearings, and vote on all matters before the Board.
  • Revised language to reflect current Arizona Open Meeting Law requirements.
  • Establishment of a rule requiring disclosure and proper handling of ex parte communications, consistent with the Planning & Zoning Commission rules.
  • Directions for public hearing conduct.
  • Clarifications on voting, appeals, and variances.
The Board asked how often cases might be brought before them.  Staff reported that Board of Adjustment cases have been rare, and that the last meeting was held in 2023 for the purpose of conducting elections.
 

MOTION BY Boardmember Marlon Booth, SECONDED BY Vice Chair Kent Hegedus to APPROVE the proposed amendments to the Rules of Procedure for the Board of Adjustment. The motion carried by the following vote:
