|
| TO: | HONORABLE MAYOR AND COUNCILMEMBERS |
| FROM: | JIM SADRO, CITY MANAGER By: Elvie Balderrama, Human Resources Director |
| SUBJECT: | APPROVE DENIAL OF LIABILITY CLAIM OF HYUN PARK AND JEAN YI FOR BODILY INJURY AND PROPERTY DAMAGE |
RECOMMENDATION:
That the City Council approve denial of the claim of Mr. Hyun Park and Ms. Jean Yi in order to set a definite six-month Statute of Limitations date.
DISCUSSION:
On August 11, 2020 a bodily injury and property damage claim for unspecified damages was filed by an attorney on behalf of Mr. Hyun Park, a City of La Palma resident, and Ms. Jean Yi, a City of La Habra resident. The claim alleges that on July 15, 2020, Mr. Park was traveling south on Idaho Street at the intersection of Lambert Road when he collided with another vehicle. Ms. Yi evidently was a passenger in Mr. Park's vehicle. Both claimants allege that they sustained bodily injuries, as well as damage to their vehicle. The claim alleges that the City failed to place stop signs during a Southern California Edison planned power outage which caused the traffic signals to be inoperative at the intersection of Idaho Street and Lambert Road.
