APPROVE CONTRACT CHANGE ORDER NO. 1 FOR EBS GENERAL ENGINEERING, INC. TO REHABILITATE EUCLID STREET FROM LA HABRA BOULEVARD TO WHITTIER BOULEVARD AND BEACH BOULEVARD NEAR THE COYOTE CREEK CHANNEL

RECOMMENDATION:


That the City Council:
A.  Approve and authorize staff to execute Change Order No. 1 in the amount of $558,471 with EBS General Engineering, Inc., to include additional pavement improvements along Euclid Street, between La Habra Boulevard and Whittier Boulevard, and along Beach Boulevard near the Coyote Creek Channel, as part of the Annual Arterial Street Rehabilitation Fiscal Year 2019-2020, City Project No. 5-R-19; and

B.  Approve the transfer of $550,000 from Measure M2 Funds and $150,000 from Gas Tax Funds, for a total of $700,000, from the approved Fiscal Year 2022-2023 CIP Budget, Annual Arterial Rehabilitation Project (Euclid Street between La Habra Boulevard and Whittier Boulevard) CIP No.16 to Annual Arterial Street Rehabilitation Fiscal Year 2019-2020, City Project No. 5-R-19 for expenses related to Change Order No.1, which includes funding for a 15 percent construction contingency, inspection services, and material testing; and,

C.  Authorize the City Manager to increase the City's Purchase Order with EBS General Engineering, Inc., by $642,250 which includes a 15 percent contingency, from the current amount of $2,573,701 to the amount of $3,215,951.

DISCUSSION:

On May 18, 2022, the City Council awarded the Annual Arterial Street Rehabilitation Fiscal Year 2019-2020, City Project No. 5-R-19 (Project) to EBS General Engineering, Inc., of Corona (Contractor), California.  The contractor is scheduled to mobilize to begin work on Monday, September 26, 2022.

In July 2022, City staff completed the design of Euclid Street improvements between La Habra Boulevard and Whittier Boulevard, a resurfacing project that was approved as part of the Fiscal Year 2022-2023 CIP Budget. This section of Euclid Street has a current average pavement condition index (PCI) of 50, which is considered to be a "poor" rating.  In order to expedite the rehabilitation of Euclid Street, staff recommends adding this portion of Euclid Street to the current Annual Arterial Street Rehabilitation Fiscal Year 2019-2020, City Project No. 5-R-19. The approved FY22-23 CIP Budget includes funding for street rehabilitation of Euclid Street from La Habra Blvd. to Whittier Blvd. which is listed in the budget as the Annual Arterial Rehabilitation Project FY22-23 (Euclid Street between La Habra Boulevard and Whittier Boulevard - CIP No. 16). This Annual Arterial Rehabilitation Project for FY22-23 included street rehabilitation of Euclid Street between La Habra Boulevard and Whittier Boulevard, however, the project would not have been initiated until later in 2023 or early 2024. In an effort to accelerate needed improvements on this portion of Euclid Street, staff is recommending the transfer of $700,000 of budgeted capital project funds from the FY22-23 CIP budget to the current City Project 5-R-19, so that Euclid Street improvements can be made this year. If approved, the requested transfer of funds will not impact any other planned street improvement projects that were scheduled as part of the approved FY22-23 CIP budget.

In addition, as part of this proposed change order, staff also recommends permanent pavement repairs along Beach Boulevard near Coyote Creek. In April 2022, a water mainline failed on Beach Boulevard north of Imperial Highway near the Coyote Creek Channel, which prompted emergency repairs. Although the pavement in the vicinity was temporarily repaired as part of the emergency repairs, a final pavement resurfacing is still pending. If this change order is approved, the necessary final pavement repairs will be made.

The Contractor submitted a price of $558,471 to repave Euclid Street between La Habra Boulevard and Whittier Boulevard, as well as repaving on Beach Boulevard near the Coyote Creek Channel. Staff reviewed the proposal and found the price to be reasonable and comparable with other unit bid prices associated with the Annual Arterial Street Rehabilitation Fiscal Year 2019-2020, City Project No. 5-R-19.  The scope of work for this additional work includes grinding, repaving the streets and replacement of damaged concrete sidewalk, curb and gutter. If approved, improvements along Euclid Street and Beach Boulevard will be scheduled to commence in November 2022.

Staff recommends that the City Council approve and authorize staff to execute Change Order No.1 in the amount $558,471 with EBS General Engineering, Inc., for the proposed improvements on Euclid Street and Beach Boulevard and authorize transferring $550,000 Measure M2 Fund and $150,000 Gas Tax Fund for a total of $700,000 from the approved Fiscal Year 2022-2023 CIP Budget, Annual Arterial Rehabilitation Project (Euclid Street between La Habra Boulevard and Whittier Boulevard - CIP No.16) to the Annual Arterial Street Rehabilitation Fiscal Year 2019-2020, City Project No. 5-R-19. This will fund the rehabilitation of asphalt streets, sidewalk, curb and gutter replacement, will provide for a 15 percent construction contingency, as well as funds for additional inspection and material testing triggered by the extra work to be performed by the Contractor, per Change Order No.1.

FISCAL IMPACT/SOURCE OF FUNDING:

If approved, Change Order #1 (Attachment 1) will require transferring $550,000 of Measure M2 Funds and $150,000 of Gas Tax Funds, for a total of $700,000, from the approved Fiscal Year 2022-2023 CIP Budget, Annual Arterial Rehabilitation Project FY22-23 (Euclid Street between La Habra Boulevard and Whittier Boulevard - CIP No. 16) to the Annual Arterial Street Rehabilitation Fiscal Year 2019-2020, City Project No. 5-R-19 Budget. This transfer of funds will cover the cost of additional paving, a 15 percent contingency, along with inspection and material testing costs triggered by the extra work to be performed by the Contractor, per Change Order No.1. The Annual Arterial Rehabilitation Project FY22-23 (Euclid Street between La Habra Boulevard and Whittier Boulevard - CIP No. 16) has an adopted budget of $975,000, which is sufficient for the requested transfer of $700,000 for work and expenses related to Change Order No. 1.

If approved, the Purchase Order with EBS General Engineering, Inc., will be increased by $642,250 which includes a 15 percent contingency, from the amount of $2,573,701 to the amount of $3,215,951.
