SUBJECT:
APPROVE PLANS AND SPECIFICATIONS AND AWARD CONTRACT TO PALP, INC., DBA EXCEL PAVING COMPANY, FOR THE CONSTRUCTION OF THREE NEIGHBORHOOD TRAFFIC MANAGEMENT PROGRAM (NTMP) PROJECTS

RECOMMENDATION:


That the City Council:
A.  Approve the Plans and Specifications for the Construction of NTMP Neighborhoods K, L, & M Traffic Management Plans, City Project No. 3-TC-19; Neighborhoods J, F, & N Traffic Management Plans, City Project No. 3-TC-20; and Neighborhoods E, A, & C Traffic Management Plans, City Project No. 4-TC-20;

B.  Approve award of contract to PALP, Inc., dba Excel Paving Company of Long Beach, California, in the amount of $497,820 for the Construction of NTMP Neighborhoods K, L, & M Traffic Management Plans, City Project 3-TC-19; Neighborhoods J, F, & N Traffic Management Plans, City Project 3-TC-20; and Neighborhoods E, A, & C Traffic Management Plans, City Project 4-TC-20;

C.  Amend the adopted budget to exchange previously budgeted General Capital Projects funds with available unencumbered Traffic Impact Fee funds in the amount of $336,740;

D.  Appropriate $210,862 in additional funding from available unencumbered Traffic Impact Fees for the Project to fully fund construction, construction management, and inspection services; and,

E.  Authorize the City Manager to execute an Agreement with PALP, Inc., dba Excel Paving Company of Long Beach, California, in the amount of $497,820, and authorize staff to issue a purchase order to PALP, Inc., dba Excel Paving Company of Long Beach, California, in the amount of $547,602; which includes a ten percent (10%) contingency.

DISCUSSION:

The proposed construction for the City's Neighborhood Traffic Management Program (NTMP) Neighborhoods K, L, & M, City Project No. 3-TC-19; Neighborhoods J, F, & N, City Project No. 3-TC-20; and Neighborhoods E, A, & C, City Project No. 4-TC-20 (“Project”) will include the installation of asphalt concrete (AC) speed lumps, new traffic signs, relocation of existing traffic signs, new rectangular rapid flashing beacons (RRFB's), installation of solar-powered LED flashing sign system as well as solar-powered radar speed feedback signs, removal and replacement of traffic striping, in addition to other associated work required for the complete installation of the proposed traffic-calming devices throughout the City, as identified on the Project plans and specifications (Attachments 3 - 5).

Despite the City conducting traffic studies, developing recommending traffic-calming solutions and holding numerous community meetings with all nine neighborhoods, residents in Neighborhood L and Neighborhood N did not support the implementation of traffic-calming plans within their neighborhood; therefore, due to a lack of support from these two neighborhoods, no improvements are being proposed in those specific areas at this time.
 
 

It should be noted that the neighborhood segments in this staff report being proposed for NTMP improvements represent the last of 15 areas of the City that were approved in the original NTMP program started over a decade ago. Once improvements have been completed in these neighborhoods, staff will conduct follow-up assessments regarding the effectiveness of the traffic calming measures, and will return to Council at a future date with a recap of the entire original NTMP program and will seek direction regarding whether the program should be renewed to include new neighborhood areas in the City that have requested to be considered for NTMP traffic calming. 

The Project was advertised in the Orange County Register and the City received a total of one (1) bid for the Project, with the following result:

After reviewing the bid cost and conducting a thorough analysis of the bid documents, staff determined that PALP, Inc., dba Excel Paving Company (Excel Paving), of Long Beach, California, submitted a responsive bid in the amount of $497,820.  The bid came in approximately 4.3% higher than the engineer’s estimate due to higher than anticipated costs related to materials and labor.  Staff reviewed work references provided by Excel Paving and found them to be satisfactory.  It should be noted that Excel Paving has established a successful past history of work with the City, most recently successfully completing the widening of Whittier Boulevard and Hacienda Road. 

Staff recommends that the City Council accept the bid, award a contract to Excel Paving Company, and authorize staff to allocate additional funding to fully fund the NTMP Projects.  

FISCAL IMPACT/SOURCE OF FUNDING:

Following is a summary of the previously approved budgets and design related expenses to date for each of the proposed NTMP neighborhood areas:

*No improvements are being proposed due to lack of support from this neighborhood.

Due to higher than anticipated construction costs, and in order to provide sufficient funding to complete the Project, staff recommends that the City Council appropriate an additional $210,862 from available unencumbered Traffic Impact Fees for this Project to fully fund the construction costs, including a 10% contingency, construction management, and inspection services. If approved, the total budget for this project will be amended from $450,000 to $660,862.

Additionally, staff recommends that the City Council approve a budget amendment to exchange $336,740 of remaining budgeted General Capital Projects funds for this Project with an appropriation of available unencumbered Traffic Impact Fees in the same amount. If approved by Council, this exchange of capital funding will make discretionary General Capital Projects funds available for use on other Capital projects in the future, subject to Council approval. 

No other budgeted capital projects will be impacted by the recommended $547,602 appropriation Traffic Impact Fees for this project.
