APPROVE AWARD OF CONTRACT TO AID BUILDERS, INC., FOR EAST BISHOP STORM DRAIN IMPROVEMENTS PROJECT, CITY PROJECT NO. 1-D-16

RECOMMENDATION:


That the City Council:
A.  Approve the Plans and Specifications for the East Bishop Storm Drain Improvements Project, City Project No. 1-D-16;

B.  Award construction contract for the East Bishop Storm Drain Improvements Project, City Project No. 1-D-16 to AID Builders, Inc., of Los Alamitos, California, in the amount of $1,778,657 and reject all other bids;

C.  Authorize the City Manager to execute an agreement with AID Builders, Inc., of Los Alamitos, California, in the amount of $2,134,388; which includes a 20 percent contingency; and,

D.  Appropriate $1,519,791 from the American Rescue Plan Act Fund (ARPA) to provide funding for the cost of construction, inspection, and materials testing for the East Bishop Storm Drain Improvements Project, City Project No. 1-D-16.

DISCUSSION:

In 2016 the City Council approved The East Bishop Drive Temporary Channel Bracing, Project No. 1-D-15 (Project) to construct steel bracing to temporarily support the channel walls and prevent the walls from collapsing. The East Bishop Storm Drain channel is located near Cypress Street and Bishop Drive, north of Whittier Boulevard. The existing rectangular open air channel starts at Cypress Street and curves to the north past Bishop Drive, meandering between homes within the City's drainage easement. Temporary bracing was installed, and now the City is prepared to construct permanent repairs to this segment of storm channel.

If approved by Council, this Project will replace the existing deficient rectangular open air channel with a 72-inch Reinforced Concrete Pipe (RCP) that will be buried underground, realign existing water pipes, street pavement reconstruction, curb, gutter, sidewalk, and driveway reconstruction; and additional associated work as identified in the Project's Plans and Specifications. 

On October 26, 2022, staff received the following bids:

Beador Construction Company, Inc. submitted the lowest bid in the amount of $1,497,700; however, after further reviewing their bid documents, Beader Construction Company, Inc. failed to submit all required documents, deeming their bid as non-responsive. The missing bid documents are critical pages of the proposal and not considered to be erroneous; therefore, their bid should be rejected. Staff reviewed the second-lowest bid from AID Builders, Inc., and found their bid responsive. AID Builders, Inc. submitted a responsive bid in the amount of $1,778,657, which is approximately 10% less than the Engineer's estimate. 

Staff reviewed AID Builders' references and found their record of performance to be satisfactory, with no record of excessive or unreasonable change order requests initiated by the Contractor. Staff recommends that the City Council award a contract to AID Builders, Inc., appropriate additional funding for this project, and authorize the City Manager to execute an agreement.

FISCAL IMPACT/SOURCE OF FUNDING:

The Project is included in the Fiscal Year (FY) 2022-2023 Capital Improvement Program (CIP) with a total approved budget of $831,500 from Capital Projects Fund and ARPA Funds. The remaining budget for construction is $730,209 after accounting for costs incurred for the project design work. Due to the higher than anticipated cost of this project, staff requests City Council to appropriate additional funds to cover the full cost of construction, inspection, and material testing for this project.
