APPROVE DENIAL OF LIABILITY CLAIM OF CYPRESS POINT APARTMENTS/STERLING PROPERTY MANAGEMENT

RECOMMENDATION:


That the City Council deny the claim of Cypress Point Apartments/Sterling Property Management in order to set a definite six-month Statute of Limitations date.

DISCUSSION:

On April 12, 2023, Attorney Robert M. Dickson filed a property damage claim on behalf of Cypress Point Apartments/Sterling Property Management in the amount of $35,000. The claim alleges that the contractor hired by the City of La Habra to perform road and curb work on Palm Street covered a cut-out for a curb drain from this property which, due to the heavy rains at the time, caused water to back up into the apartment complex that would have normally drained out to the street. This claim was tendered to the City's contractor conducting street paving work at that location.
