APPROVE RESOLUTIONS ADOPTING MEMORANDUMS OF UNDERSTANDING WITH LA HABRA POLICE ASSOCIATION SWORN AND CIVILIAN, AND APPROVE A RESOLUTION AMENDING RESOLUTION 6115 PERTAINING TO COMPENSATION FOR EXEMPT POLICE MANAGEMENT

RECOMMENDATION:

 
That the City Council:
A.  APPROVE AND ADOPT RESOLUTION NO. ____ ENTITLED:  A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, ADOPTING MEMORANDUMS OF UNDERSTANDING BETWEEN THE CITY OF LA HABRA AND THE LA HABRA POLICE ASSOCIATION SWORN AND CIVILIAN PERSONNEL; and

B.  APPROVE AND ADOPT RESOLUTION NO. ____ ENTITLED:  A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, AMENDING RESOLUTION NO. 6115 PERTAINING TO A COMPENSATION PLAN FOR POLICE MANAGEMENT EMPLOYEES; and

C.  Approve an appropriation of funds from the Fiscal Year 2022-2023 adopted budget for the first year cost of one-time lump sum pay adjustments for the stated employee groups.

DISCUSSION:

Representatives from the La Habra Police Association (LHPA) and City Management have met and conferred in good faith in accordance with the Meyers Milias-Brown Act regarding salary, benefits, and other terms and conditions of employment, and have reached tentative agreements for successor Memorandum of Understanding. LHPA Sworn and Civilian have agreed to two-year terms for the period of July 1, 2023, through June 30, 2025. 

Consistent with City Council direction, the proposed education pay and benefits for Police Management employees is included for consideration.

The key economic changes for each group are as follows:

POLICE – TWO-YEAR TERM FOR THE PERIOD OF JULY 1, 2023 – JUNE 30, 2025:

Salary adjustment for all Police Association members:
  • 5% base salary adjustment effective on August 12, 2023.
  • 2% base salary adjustment for sworn personnel and Communication Operator services effective on January 13, 2024.
  • 4% base salary adjustment effective on July 13, 2024.
  • Full-time Civilian employees as of May 31, 2023, will receive a one-time lump-sum payment in the amount of $2,500 after City Council approval. Employees must still be employed as of August 17, 2023. 
  • Full-time Civilian employees as of May 31, 2024, will receive a one-time lump-sum payment in the amount of $1,500 no later than June 30, 2024; employees must still be employed as of June 28, 2024.
  • Full-time Sworn employees as of May 31, 2023, will receive a one-time lump-sum payment equal to two percent (2%) of base annual pay based on their salary in effect as of June 30, 2023, after City Council approval.  Employees must still be employed as of August 17, 2023.
  • Full-time Sworn employees as of May 31, 2024, will receive a one-time lump-sum payment equal to two percent (2%) of base annual pay based on their salary in effect as of June 28, 2024; employees must still be employed as of June 28, 2024.
Cafeteria Medical Allowance:
  • Effective December 1, 2023, the City provide a monthly cafeteria contribution as follows:
    • Employee:              $1,450
    • Employee +1:         $1,675
    • Employee +2:         $1,850
  • Effective December 1, 2024, the City provide a monthly cafeteria contribution as follows:
    • Employee:              $1,450
    • Employee +1:         $1,750
    • Employee +2:         $1,950
Special Assignment Pay (Sworn Only)
  • Effective July 1, 2023, the City will increase the special assignment pay by $50 per month to a maximum of $400 per month.
POST Certificate Pay
  • Intermediate POST  $500
  • Advanced POST      $800 
  • Supervisory POST   $1,100
  • Advanced POST certificate for dispatchers $300
Shift Differential (Civilian Only)
  • Swing Shift             $1.00/hour
  • Graveyard Shift       $2.00/hour

FISCAL IMPACT/SOURCE OF FUNDING:

If approved by City Council, the combined total cost of both the sworn and civilian the two-year MOUs are estimated to be approximately $2,022,710 and allocated as follows:

FY2023-2024:                             $1,218,775
FY2024-2025:                             $803,935

The estimated two-year total cost of the MOU with the La Habra Police Association/Sworn Employees consists of both recurring costs and “one-time” costs apportioned between the General Fund and Non-General Fund sources.

PUBLIC SAFETY MANAGEMENT RESOLUTION
Public Safety Management Only
  • Effective December 1, 2023, the City provide a monthly cafeteria contribution as follows on a use or lose basis:
    • Employee:              $1,450
    • Employee +1:         $1,675
    • Employee +2:         $1,850
 
  • Effective December 1, 2024, the City provide a monthly cafeteria contribution as follows on a use or lose basis:
    • Employee:              $1,450
    • Employee +1:         $1,750
    • Employee +2:         $1,950
 
 

Education Incentive

Effective August 12, 2023, employees in the classification of Sworn Police Captain shall be eligible for additional compensation paid bi-weekly as follows:
  • POST Management Certificate: $1,400/mo. ($646.153/pay period).
If approved by City Council, the total cost to the general fund of the two-year Resolution for exempt Police Management staff is estimated to be approximately $15,675 and allocated as follows:
