RECOMMENDATION:
That the City Council deny the claim of Ms. Margaret Garcia in order to set a definite six-month Statute of Limitations date.
DISCUSSION:
Ms. Margaret Garcia, a City of La Habra resident, filed a property damage claim on October 18, 2023, in the amount of $1,366.13. The claim alleges that water from a broken storm drain behind the property overflowed into the claimant’s backyard, causing damage to the pool, spa, and the concrete area around the pool. Due to the damages that occurred, the claimant hired a contractor to repair the concrete, drain, treat, and refill the pool. The storm drain that allegedly overflowed is privately owned and maintained by the Union Pacific Railroad Company.
