APPROVE CONFLICT OF INTEREST CODE - BIENNIAL NOTICE OF REQUIRED AMENDMENTS

RECOMMENDATION:


That the City Council:
A.  Receive and file the 2024 Local Agency Biennial Notice to Amend the Conflict of Interest Code for designated employees of the City of La Habra;

B.  Direct staff to notice and report any public comments to City Council for consideration; and,

C.  Direct staff to prepare a revised Conflict of Interest Code within 90 days for submittal to the City Council for final approval and adoption.

DISCUSSION:

The Political Reform Act requires cities in California to adopt Conflict of Interest Codes for the filing of Statements of Economic Interests by designated employees of the city. A designated employee is defined as an employee or consultant whose position entails the making or participation in the making of governmental decisions that may have a material effect on any financial interest.

The Political Reform Act (GCS 87300 - 87313) requires each local government agency in California to review its Conflict of Interest Code biennially to determine if it is accurate, or alternatively, if the Conflict of Interest Code must be amended. Once a determination has been made, a notice must be submitted to the City Council no later than October 1st of even-numbered years. After receipt of the Biennial Notice, the City Council has 90 days in which to adopt an amended Conflict of Interest Code.  Further, GCS 87311 requires staff to notice and allow a fair opportunity for officers, employees, members, consultants, and residents of the city to review the proposed revised Code and to present their views prior to its submission to the City Council.

Staff is currently in the review process of the Code in order to determine if amendments, such as the addition of new positions and/or title changes, are needed. The specific revisions will be submitted to the City Council within 90 days for final review, approval and adoption by resolution.

FISCAL IMPACT/SOURCE OF FUNDING:

None.

GENERAL PLAN RELEVANCE/CITY COUNCIL GOALS & OBJECTIVES:

City Council's direction to staff to prepare a revised Conflict of Interest Code for City Council consideration would help ensure compliance with applicable state law and aid the City in its implementation of the General Plan, which is predicated upon good governance practices.  Approval of staff's recommendation is therefore consistent with the General Plan's Vision Statement, which is to "assure the retention of the community character that has developed over the past decades."
