APPROVE THE AWARD OF A CONTRACT TO PALP, INC. DBA EXCEL PAVING COMPANY, FOR HARBOR BOULEVARD AT ARBOLITA DRIVE INTERSECTION SAFETY IMPROVEMENTS, CITY PROJECT NO. 3-R-23

RECOMMENDATION:


That the City Council:
A. Approve the Project Plans and Specifications for the Harbor Boulevard at Arbolita Drive Intersection Safety Improvements, City Project No. 3-R-23; 

B. Award a construction contract for the Harbor Boulevard at Arbolita Drive Intersection Safety Improvements, City Project No. 3-R-23, to Palp, Inc., dba Excel Paving Company, of Long Beach, California, in the amount of $508,350 and reject all other bids; 

C. Authorize the City Manager to execute an agreement with Palp Inc. dba Excel Paving Company and authorize staff to issue a purchase order in the amount of $559,185, which includes a 10 percent contingency; and,

D. Approve an appropriation of $95,185 from the Measure M2 Fair Share fund balance to fully fund the Harbor Boulevard at Arbolita Drive Intersection Safety Improvements, City Project No. 3-R-23.

DISCUSSION:

Over the past several years, the signalized intersection of Harbor Boulevard and Arbolita Drive has experienced several vehicle collisions that have resulted in both public and private property damage. The goal of the Harbor Boulevard at Arbolita Drive Intersection Safety Improvments, City Project No. 3-R-23 ("Project"), is to help reduce the number of collisions and improve traffic and pedestrian safety. The Project includes several safety improvements, such as a curb extension at the southwest corner of Harbor Blvd. and Arbolita Drive, the installation of a permanent concrete barrier, a new guardrail system, tree planting, landscaping, irrigation, lighting, and new traffic striping and signage. These improvements will be installed on the west side of Harbor Boulevard from Arbolita Drive to just north of Brookdale Avenue. 

On April 18, 2024, staff advertised the Project Plans and Specifications (Attachment No. 1) for contractors to bid on. On Thursday, May 9, 2024, the City received three (3) bids with the following results:

The apparent lowest bidder was Palp Inc. dba Excel Paving Company (Palp). Staff reviewed the lowest bid from Palp and found their bid to be responsive. Staff reviewed Palp's references and found their record of performance to be satisfactory, with no record of excessive or unreasonable change orders initiated by the Contractor. Also, Palp has worked on similar projects in the past in the City of La Habra and staff confirmed that their prior work product was satisfactory; therefore, staff is recommending that the City Council award a construction contract to Palp Inc. dba Excel Paving Company and authorize the City Manager to execute an agreement (Attachment 2) and appropriate $95,185 from the Measure M2 Fair Share fund balance to fully fund construction, construction management, design support, and material testing. 

FISCAL IMPACT/SOURCE OF FUNDING:

The Project is included in the Fiscal Year 2023-2024 Capital Improvement Program with a total approved budget of $500,000, comprised of $300,000 from Traffic Impact Fee funds and $200,000 of Measure M2 Fair Share funds. It should be noted that the low bid presented by Palp Inc., dba Excel Paving Company is higher than the approved budget; therefore, staff recommends that the City Council approve an additional appropriation of $95,195 from the available Measure M2 Fair Share fund balance to fully fund the construction, construction management, design support and material testing.
