RECOMMENDATION:
That the City Council deny the claim of Mercury Insurance in order to set a definite six-month Statute of Limitations date.
DISCUSSION:
On October 13, 2020, Mercury Insurance filed an amended property damage claim on behalf of their insured, Mr. Jose Alberto Sanchez, in the amount of $1,455.66 for damages to Mr. Sanchez’s vehicle. The claim alleges that, on August 23, 2020, Mr. Sanchez' vehicle was parked in front of 1210 West Lambert Road when a tree branch fell on the vehicle causing damage.
Staff reviewed the claim and site of the alleged incident and determined that the tree in question is on private property and is not owned or maintained by the City.
