SUBJECT:
APPROVE AWARD OF CONTRACT TO GENESIS BUILDERS, INC. FOR THE VISTA GRANDE PARK RESTROOM PROJECT, CITY PROJECT NO. 1-P-25

RECOMMENDATION:


That the City Council: 
A.  Approve the Plans and Specifications for the Vista Grande Park Restroom Project, City Project No. 1-P-25;

B.  Award a construction contract for the Vista Grande Park Restroom Project, City Project No. 1-P-25 to Genesis Builders, Inc., of Fullerton, California, in the amount of $1,020,000 and reject all other bids;

C.  Authorize the City Manager to execute an agreement with Genesis Builders, Inc., and issue a purchase order in the amount of $1,122,000; which includes a 10 percent contingency; and,

D.  Approve an appropriation of $877,000 from available, unencumbered Park Acquisition Funds to fully fund construction, construction management, labor compliance, inspection, and design support services associated with the Vista Grande Park Restroom Project, City Project No. 1-P-25.

DISCUSSION:

On October 16, 2023, the City Council awarded a construction contract to redevelop a city-owned site, formerly known as Vista Grande Park, consisting of 17.7 acres of undeveloped land located at 1100 West Lambert Road, into a family-oriented recreation park. The site was formerly operated as a landfill, which has been closed for several decades. After years of planning, design, and public input, the construction of the park is well underway, and includes amenities such as open play areas; a walking and running path; exercise stations; roadways and parking areas; playground equipment; an art wall; a food truck circle; an amphitheater; a drought tolerant demonstration garden; landscaping/irrigation; installation of stormwater drainage basins; tree planting; a gazebo; volleyball, basketball, and pickleball courts; picnic tables; the City's first ever dog park; and other amenities. The project also includes modifications to the landfill gas control system and the installation of a new landfill cap to meet regulatory agency requirements such as the California Regional Water Board (Santa Ana RWQCB), CalRecycle, and the local environmental enforcement agency (LEA). In September 2024, the City Council approved the renaming of Vista Grande Park to Vin Scully Centennial Park.  Construction to build the park began in 2024 and is expected to be completed in Summer 2025, in conjunction with the City's Centennial celebration, weather permitting.

The installation of a new pre-fabricated restroom was part of the original design package for the park project; however, due increasing costs and budgetary constraints, staff reevaluated bathroom designs and options and opted to redesign the restroom and bid the restroom project as a stand-alone project to provide more opportunities for competitive bids. On January 30, 2025, the City released a Notice of Inviting Bids on PlanetBids for the construction of the Vista Grande Restroom Project, City Project No. 1-P-25 ("Project"). It should be noted that, while the current park name is Vin Scully Centennial Park, the original bid package was prepared under the former park name of Vista Grande since the original park project carried that name. The project is therefore referred to as the "Vista Grande Restroom Project, City Project No. 1-P-25."

On February 26, 2025, staff received the following bids, ranked in order from lowest to highest:

During the process of reviewing and analyzing the submitted bids, staff received a formal letter (Attachment 1) from the apparent low bidder, ASAD Holdings, LLC, requesting to withdraw their bid. Therefore, staff reviewed the second lowest bid from Genesis Builders, Inc. ("Genesis"). Despite not submitting Addendum No. 1 in their bid package, Genesis did acknowledge the issued addenda in their bid. Due to this irregularity, staff consulted with the City Attorney's office for advice. The City Attorney's office considered this a minor irregularity that could be waived by the City. Staff checked Genesis' references and found their record of performance to be satisfactory, with no record of excessive or unreasonable change order requests initiated by the Contractor. Therefore, Genesis' bid was found to be responsive. Furthermore, no letter(s) of protest were received opposing the award of this Project to Genesis Builders. 

Therefore, staff recommends that the City Council award a construction contract to Genesis Builders, Inc., authorize the City Manager to execute an agreement (Attachment 2), and appropriate $877,000 from available, unencumbered Park Acquisition Funds to fully fund construction, construction management, and inspection, as required by the Project. If approved, this Council action will also increase the purchase order for additional support services from the current park project team, e.g. Z&K Consultants, the construction management, labor compliance, and inspection consultant, and IDS Group, the Architect on record who prepared the original Project's plans and specifications. A breakdown of the requested allocation of funds is detailed in the Fiscal Impact/Source of Funding section of this report. 

FISCAL IMPACT/SOURCE OF FUNDING:

On August 28, 2024, the City received notification from the Office of Community Planning and Development, U.S. Department of Housing and Urban Development (HUD) that the City was a successful grant applicant and was awarded $500,000 in Federal HUD Fiscal Year 2024 Economic Development Initiative - Community Project Funding (CPF) grant funds for the Vista Grande Park Restroom Project, City Project No. 1-P-25. To date, staff has received no notification that this federal funding will be canceled by HUD; however, staff will continue to monitor the changing federal funding guidelines and will report back if this approved grant funding is revoked.

In addition to the acceptance and allocation of this new Federal grant fund, staff is requesting an appropriation of available, unencumbered Park Acquisition Funds in the amount of $877,000 to fully fund the Project. There is sufficient funding in this account to cover the additional appropriation.

If approved, a total of $1,377,000 will be available to fully fund the Vista Grande Park Restroom Project, City Project No.  1-P-25.
