RECOMMENDATION:
That the City Council APPROVE THE FIRST READING OF ORDINANCE NO. _____ ENTITLED: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, ADDING CHAPTER 2.58 ("CAMPAIGN CONTRIBUTION LIMITS") TO TITLE 2 ("ADMINISTRATION AND ORGANIZATION") OF THE LA HABRA MUNICIPAL CODE RELATING TO CAMPAIGN CONTRIBUTION LIMITS
DISCUSSION:
On October 8, 2019, the State of California enacted Assembly Bill 571 (AB 571) which imposes campaign contribution limits in cities that do not have contribution limits. AB 571 amended Government Code Section 85301 to impose local campaign contribution limits in the amount set by the Fair Political Practices Commission pursuant to Government Code Section 83124. Currently, this amount is $4,700. Under AB 571, cities may adopt campaign contribution limits that are higher or lower than this amount; however, those cities without a local limit, will be bound by the State limit effective January 1, 2021.
La Habra does not currently have campaign contribution limits for its municipal elections and, absent any action by the City Council, it will be bound by the State limit beginning January 1, 2021. During its meeting on January 21, 2020, the Council directed staff to prepare an ordinance that codifies the State limit in the La Habra Municipal Code.

The attached ordinance adds Chapter 2.58 to the La Habra Municipal Code and codifies the campaign contribution limit imposed by State law. The ordinance states that, in the event the State revises campaign contribution limits in the future, the City’s limit will automatically mirror those changes. The proposed ordinance will be enforced in a manner consistent with other city ordinances, which include potential administrative, civil or criminal penalties in the event of a violation of the code.
