DULY NOTICED PUBLIC HEARING TO CONSIDER A REQUEST FOR CONDITIONAL USE PERMIT 25-0013 (CUP25-0013) TO IMPLEMENT A SIGN PROGRAM FOR A VEHICLE SERVICE STATION AND CONVENIENCE STORE LOCATED AT 750 NORTH HARBOR BOULEVARD 

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA):

This project was reviewed pursuant to the guidelines of the California Environmental Quality Act (CEQA) and determined to be categorically exempt pursuant to Section 15311, Class 11: “Accessory Structures” of the CEQA Guidelines. The Class exemption 11 consists of construction or placement of minor structures accessory to existing commercial, industrial, or institutional facilities, including on-premise signs. The proposed project involves only the construction of wall signs and the replacement of one freestanding sign. No modifications are being proposed to the existing building and/or site, and all signage proposed will be located on the project site. 

This project is not subject to any of the exceptions for exemption under Section 15300.2 of the CEQA Guidelines. The location of the project is predominantly urban and not considered a sensitive environment; therefore, the project will not result in any significant environmental impact. The cumulative impact of this project, and the approval of other projects like it in the vicinity, is not expected to have any significant environmental impact. The project is not located along any state-designated scenic highway nor within any designated hazardous waste site. The Project will not cause a substantial adverse change in the significance of any historical resource. Staff do not expect any significant impacts or unusual circumstances related to the approval and construction of the project. Therefore, the project is categorically exempt from CEQA.

RECOMMENDATION:

That the Planning Commission approve and adopt:

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA HABRA, CALIFORNIA, MAKING THE REQUIRED FINDINGS AND APPROVING CONDITIONAL USE PERMIT 25-0013 (CUP25-0013) TO IMPLEMENT A SIGN PROGRAM FOR AN AUTOMOBILE SERVICE STATION AND CONVENIENCE STORE LOCATED AT 750 NORTH HARBOR BOULEVARD, AS PER THE APPROVED PLANS AND SUBJECT TO CONDITIONS, AND MAKING THE DETERMINATION THAT THE PROJECT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO SECTION 15311, CLASS 11: “ACCESSORY STRUCTURES” OF THE CEQA GUIDELINES

DISCUSSION:

The Applicant, Fred Cohen of CJC Design Inc., on behalf of the property owner, David Berri of Imperial Stations, Inc., is requesting the approval of Conditional Use Permit 25-0013 (CUP25-0013) to allow for a Sign Program (the "Project") for a previously approved automobile service station and convenience store at 750 North Harbor Boulevard ("Project Site"). The subject property is located on the southeast corner of North Harbor Boulevard and East Whittier Avenue, as identified below in Exhibit 1 – Vicinity Map. The automobile service station and convenience store are currently under construction.

The General Plan designates the Project Site for Mixed-Use Center 1 land use, and the Project Site is within the C-2 (Commercial) Zone, which implements the Mixed-Use Center 1 General Plan land use designation. The parcel has historically been developed with an automobile service station. In September 2022, the Planning Commission adopted Resolution No. 22-41 approving CUP 22-03 to allow for an automobile service station with a convenience store containing six gas pumps and a 2,400 square-foot convenience store building. The General Plan land use designation, zoning and existing land use for the Project Site and each of the surrounding properties are provided in Table 1 below:

Pursuant to the Conditions of Approval adopted by Resolution No. 22-41 for CUP 22-03, the property owner is required to submit a Sign Program for the property and receive approval, prior to the issuance of any sign permits. The proposed Sign Program consists of three sign types: gas station canopy signs (A), a freestanding sign (B), and wall signs (C & D) in the locations identified in Exhibit 2 below. Non-residential signs are typically required to comply with La Habra Municipal Code (LHMC) Section 18.23.080 (Sign Regulations – Nonresidential); the requirements for automobile service station, freestanding and wall signs are shown below in Table 2. The Applicant is proposing to modify these sign standards by requesting approval of a CUP for a sign program, which is permitted pursuant to paragraph 2 of subsection D of LHMC Section 18.23.050 (Sign Program Required).

Automobile Service Station Signs

Freestanding Signs

Location
  • Freestanding sign(s) shall be set back a minimum of 15 feet from the public right-of-way. Exceptions may be granted through the review and approval of a line-of-sight study, prepared by a licensed traffic or civil engineer.
  • No freestanding sign shall be located within 250 feet of any other freestanding sign on the same business property.
  • All freestanding signs shall be placed in a landscaped area and shall have a minimum horizontal clearance of 3 feet from any adjacent area used for vehicle traffic or parking.
Number
  • 1 freestanding sign per street frontage of a property.
  • A freestanding sign shall not be permitted for each individual tenant(s).
  • Multiple freestanding tenant signs shall be subject to the approval of a Sign Program.
Area
  • Allowable sign area shall not exceed 1 square foot for each lineal foot of street frontage.
  • The sign area excludes the framework (e.g., post, masonry column or beam). For double-faced (two-sided) freestanding signs, only 1 side of the sign shall be used to determine the sign area.
Other
  • Materials, design and colors for freestanding signs shall be complementary to the materials, design and colors of the buildings for the related development.
  • All monument and pylon type signs must have a base element. The base element must be designed to "ground" the sign through materials, including but not limited to, rock masonry, or wood, or through decorative treatment consistent with that found on the associated building. 
Wall Signs

Number

  • Commercial land uses: Maximum area of each sign shall not exceed 30% of the area of each building elevation where a sign is permitted.
  • Light manufacturing and/or planned commercial Industrial land uses: Maximum area of each sign shall not exceed 15% of the area of the building elevation where a sign is permitted.
Other
  • Channel letters, reverse channel letters and push pin letters are preferred.
  • Signage containing multiple elements (e.g. logo and text) on 1 façade shall be designed so that the multiple elements are located and scaled with relationship to each other.
  • Internal and/or external illumination allowed. External light shall utilize energy-efficient fixtures compliant with Title 24 of the California Code of Regulations. Any illuminated signs that identify a business within, adjacent to, a residential zone shall be turned off within 2 hours after the business is closed.
  • Signs shall be designed to be compatible with the architectural style of the main structure or structures on the site where the signs are to be located and shall incorporate matching or similar construction materials, colors, and other design details.
 
 
As shown above in Exhibit 2 and below, in Exhibit 3, the Applicant is requesting to install two canopy signs along the gas station canopy fascia that consist of a vinyl face. The canopy fascia will feature two 7.07 square foot channel logos, on the north and south-facing sides, constructed out of internally illuminated vinyl. The canopy fascia and the logos will incorporate regionally and nationally recognized logo colors.

As shown below, in Exhibit 4, the Applicant is proposing to update the existing 22-foot-tall freestanding sign located on the corner of North Harbor Blvd and East Whittier Blvd. The existing sign measures 22’ x 6’-1” (total sign area of 96 square feet). The updated sign will utilize the existing structure, while updating the design to match the approved convenience store building. The proposed sign design will consist of internally illuminated aluminum cabinets with formed polycarbonate faces. Gas prices will be displayed using 10-inch, illuminated Red, Green, and White LEDs. The top third of the sign will be updated to add the tenant logos and incorporate regionally and nationally recognized logo colors. The sign’s design will be updated to be more cohesive with the approved buildings, sporting Pacific Clay Cultured Stone framing to cover the existing support beams and a decorative cap at the top of the sign. The decorative framing will increase the size of the sign to 22’-6” x 7’-5” (total sign area of 97.28 Square Feet). The increase to the sign will not have an impact on traffic sight lines, and will not interfere with any overhead powerlines.

As shown below, in Exhibit 5, the Applicant is proposing two tenant wall signs along the north and west faces of the approved convenience store. These signs consist of illuminated channel letters and incorporate regionally and nationally recognized logo colors. The north-facing sign will be a maximum of 3.25 feet high by 16.25 feet wide (total of 30.54 square feet in total display square footage) and the westerly-facing sign will be a maximum of 3.25 feet high by 10.7 feet wide (total of 20.56 square feet in total display square footage). These two signs deviate from the design standards of LHMC Chapter 18.23 (Sign Standards), which allow for a wall sign’s height to be a maximum of 15 percent of the total wall height that the sign is located on. As proposed, the northern-facing sign will be allowed to be a maximum of 16 percent of the respective wall height while the westerly-facing wall sign will be allowed to be a maximum of 17 percent of the respective wall height.

ANALYSIS
Pursuant to LHMC Section 18.23.050.D.2 (Conditional Use Permit), a Sign Program that deviates from the design standards of Chapter 18.23 (Sign Standards) shall be processed as a conditional use permit, pursuant to the requirements of Chapter 18.66 (Conditional Use Permits). Since the Project proposes signage that deviates from the regulations established in Chapter 18.23, it is subject to the approval of a Conditional Use Permit by the Planning Commission.  Pursuant to LHMC Section 18.66.070.C (Planning Commission Action) of Chapter 18.66 (Conditional Use Permits), in order to grant approval of the Conditional Use Permit, the Planning Commission must make the findings listed below. Each required finding is followed by staff’s analysis of the proposed Project’s ability to meet the finding.

A. The granting of the Conditional Use Permit will not be detrimental to the public welfare and will not unreasonably interfere with the use, possession and enjoyment of surrounding and adjacent properties and will not impair the character of the zone in which it is to be located.

The proposed Sign Program provides design specifications that will provide uniformity and orderly placement of multiple signs on a site that was approved for the construction and operation of a gas station and convenience store. The proposed Sign Program request under CUP25-0013 takes into careful consideration the property’s location and sign sizes to provide visual upgrades to existing signs and to fit the approved structures. The proposed Sign Program will provide visitors with clear identification of gasoline prices and site services while, at the same time, being seen as an enhancement to the commercially zoned area where the previously existing gas station was located. Therefore, the granting of CUP25-0013 will not be detrimental to the public welfare or unreasonably interfere with the use, possession and enjoyment of surrounding and adjacent properties and will not impair the character of the C-2 (Commercial) Zone.

B. The subject site is physically suitable for the type of project being proposed.

Appropriate signage is expected to help identify businesses and provide clear signage identifying gasoline prices. CUP25-0013 includes a Sign Program that meets the needs of the approved automobile service station and convenience store. Visitors will be able to clearly identify gas prices and businesses and the new sign design will complement the surrounding buildings as it considered the identification needs of both Harbor Boulevard and Whittier Avenue. The subject site can physically accommodate the proposed signage. Therefore, the subject site is physically suitable for the proposed Sign Program.

C. The proposed project is conditionally permitted within the subject zone and complies with the intent of applicable provisions of this title.
 
Pursuant to LHMC Section 18.23.050.D.2 (Conditional Use Permit), processing of a Conditional Use Permit for a Sign Program provides greater design flexibility than what is permitted under LHMC Section 18.23.080 (Sign Regulations – Nonresidential). Conditional Use Permit 25-0013 (CUP 24-0013) will allow for two building-mounted wall signs that will be up to 30.54 square feet on the north side of the building and 20.56 square feet on the west side of the building. The Sign Program will also allow for the signage to exceed the sign height maximum of 15% of the total wall height as established under LHMC Chapter 18.23. The Sign Program allows for wall signs up to 17% of the wall height. In addition to the wall signage, the Sign Program will allow for a 97.33 square foot pylon sign on the corner of North Harbor Blvd and East Whittier Ave. This pylon sign will be allowed at a maximum height of 22’-6”. Two canopy signs along the north and south sides of the gas station canopy will be allowed at a maximum square footage of 7.07 square feet. Therefore, the proposed Sign Program is conditionally permitted within the C-2 (Commercial) Zone and complies with the intent of applicable provisions of the Zoning Ordinance.

D. The granting of the Conditional Use Permit is consistent with the comprehensive General Plan.

The proposed Sign Program supports the following General Plan Policies:
  • Policy LU 5.6 Building Rehabilitation: Encourage the rehabilitation of existing commercial buildings and signage that are deteriorated or inconsistent with the intended character and quality of the City.
  • Policy LU 11.6 Enhanced Design Character: Encourage the renovation, infill, and redevelopment of existing commercial centers and corridors to improve their architectural design and quality, reduce the visual prominence of parking lots, make centers more pedestrian friendly, reduce visual clutter associated with signage, and enhance the definition and character of the street frontage and associated streetscapes.
The proposed Sign Program involves an aesthetic update to the existing signage on the Project Site, and will create a cohesive and standardized design criteria for on-site signage. Having a sign program in place will reduce visual sign clutter and enhance the definition and character of the street frontage of the site. Therefore, the granting of Conditional Use Permit 25-0013 is consistent with the General Plan.

FISCAL IMPACT/SOURCE OF FUNDING:

The Applicant has paid for the processing costs associated with the Sign Program Review, which total $803.00.

NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES):

The Applicant's proposal has been reviewed pursuant to the requirements of the City's National Pollutant Discharge Elimination System (NPDES) Municipal Permit, the Local Implementation Plan (LIP) and the Model Water Quality Management Plan (WQMP), Section 7.2. Since no disturbance of soil will occur, the project is exempted by the Water Quality Ordinance from the preparation of a WQMP.

  • Policy LU 11.6 Enhanced Design Character: Encourage the renovation, infill, and redevelopment of existing commercial centers and corridors to improve their architectural design and quality, reduce the visual prominence of parking lots, make centers more pedestrian friendly, reduce visual clutter associated with signage, and enhance the definition and character of the street frontage and associated streetscapes.

City Council Goals and Objectives:
  • Goal 5 - Development Activity and Business Assistance
    • Objective C - Work closely with commercial and residential property owners to improve and maintain the appearance of their properties. The project implements this City Council objective by encouraging the project site to create and implement a sign program to create a cohesive and standardized design criteria for on-site signage that enhances the definition and character of the site.
