| SUBJECT: | APPROVE A RESOLUTION APPOINTING JERRY L. PRICE FOR POSITION OF INTERIM POLICE CHIEF UNDER GOVERNMENT CODE SECTION 21221(h) AND APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE EMPLOYMENT AGREEMENT |
RECOMMENDATION:
That the City Council:
A. APPROVE AND ADOPT RESOLUTION NO. ____ ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA APPOINTING JERRY L. PRICE FOR POSITION OF INTERIM POLICE CHIEF UNDER GOVERNMENT CODE SECTION 21221(h); and
B. Approve and authorize the City Manager to execute the employment agreement with Jerry L. Price for position of Interim Police Chief.
DISCUSSION:
After a long and successful law enforcement career, Chief Jerry Price has announced his decision to retire effective December 19, 2020. Chief Price has proudly served as a member of the La Habra Police Department for more than 29 years, acting as the Police Chief for the past eight years. During his tenure, Chief Price has gained the confidence and respect of not only of the City Council and City Administration, but also of the men and women of the La Habra Police Department, as well as the community they serve with honor and distinction. Chief Price has provided effective leadership and oversight of the Police Department and has improved public safety operations by establishing and achieving goals and objectives consistent with the City Council's priorities.
With Chief Price’s retirement, the City will initiate a recruitment for the permanent appointment of a new Police Chief; however, to maintain operational continuity of the Police Department during the recruitment process, staff recommends retaining Chief Price as Interim Chief of Police on a temporary basis.
Chief Price possesses the specialized skills necessary to serve as Interim Police Chief as the result of his long and distinguished career in law enforcement and will continue to perform the functions and duties of the Police Chief during the term of his temporary appointment, including the planning, directing, oversight of activities and operations of the Police Department, as well as providing highly responsible and complex administrative support to the City Manager.
Per the attached agreement, the City will pay Chief Price an hourly rate of $105.80. Consistent with Government Code Sections 21221(h) and 7522.56, Chief Price will not receive any benefits or overtime compensation during his temporary appointment. This agreement will expire on December 27, 2021, or upon the hiring of a permanent Police Chief, or by mutual agreement of the City and Chief Price.

FISCAL IMPACT/SOURCE OF FUNDING:
Based on the terms of the agreement, the maximum amount the City will pay Chief Price during a six-month period, which is the anticipated recruitment period, is $101,568. The full cost, including benefits, of a permanent, full-time Police Chief at the same rate of pay over a six-month period would have been approximately $167,905.
