| SUBJECT: | APPROVE THE ACCEPTANCE OF A RIGHT-OF-WAY GRANT DEED FOR 130 AND 150 WEST WHITTIER BOULEVARD

RECOMMENDATION:
That the City Council:
A. Approve the acceptance of a dedication of additional right-of-way at 130 and 150 West Whittier Boulevard; and,
B. Approve and authorize recordation of the Grant Deed with the Orange County Clerk-Recorder.
DISCUSSION:
The owner of the subject property is proposing to operate a new restaurant (Baby Bros Pizza & Wings), planned to be placed in an improved 1,500 square-foot vacant commercial building (formerly Golden Star Restaurant) located at 150 West Whittier Boulevard. The project will require the dedication of 2.5 feet of right-of-way along the north side of the existing 15-foot-wide alley to the City of La Habra. If this dedication is approved by City Council, the City will own 17.5 feet of right-of-way width at this location.
FISCAL IMPACT/SOURCE OF FUNDING:
While the City will incur marginal long-term costs to maintain the additional asphalt, the developer will be responsible for all initial site improvements within the dedicated area. The developer has conditions to add new asphalt pavement along the 2.5 foot proposed dedication. Once these improvements are completed, the new asphalt surface is expected to have a service life of approximately 20 years.
