| SUBJECT: | APPROVE AMENDMENT NO. 1 TO AGREEMENT FOR ON-CALL ARCHITECTURAL & ENGINEERING DESIGN SERVICES FOR FISCAL YEAR 2026-2027

RECOMMENDATION:
That the City Council:
A. Waive formal bidding requirements per the La Habra Municipal Code, Chapter 4.2.080 (B) when a service firm has established such a successful past history of work with the City that it is clearly in the public interest not to negotiate with any other source;
B. Approve and authorize the City Manager to execute Amendment No. 1 to the existing Agreements with SVA Architects, Inc., of Santa Ana, California, for On-Call Architectural & Engineering Design Services to extend term of the Agreement through June 30, 2027;
C. Authorize Staff to issue Purchase Order to SVA Architects, Inc. for Fiscal Year 2026-2027 for a not-to-exceed amount of $250,000.

DISCUSSION:
On January 17, 2023, the City entered into a professional services agreement with a qualified consultant, SVA Architects, Inc., for On-Call Architectural & Engineering Design Services for a three-year term. SVA Architects provide professional services for Public Works projects including, but not limited to, architectural design, structural design, civil design, lighting, data/telecommunications, graphics, renovation of buildings and facilities, ADA design, geotechnical engineering, land survey, audio & visual, electronic security design, parking structure, knowledge of various state and federal codes, LEED requirements, maintenance facilities, mechanical/electrical/plumbing (MEP), HVAC, roofing, pergolas, park amenities, playgrounds, landscaping/irrigation, and concept drawings. The current agreement is set to expire on June 30, 2026.
SVA, Architects, Inc. has provided high-quality work for the City for the past three years and has consistently provided professional and expert support for the City's Public Works Projects. As a result of turnover within the Engineering Division over the past year, as well as the volume of projects currently being processed, staff has been unable to begin a formal Request for Proposal (RFP) process for these services prior to the current agreement's expiration. To ensure uninterrupted access to essential architectural services for various CIP projects and tasks, staff is requesting the City Council waive formal bidding requirements in accordance with the City of La Habra Municipal Code, Chapter 4.20.080 (B), which permits such action when a service provider has demonstrated a strong record of successful performance with the City, and it is clearly in the public interest to forgo a competitive process. Accordingly, staff recommends approval of Amendment No. 1 (attached), which will extend the existing Agreement for one (1) additional year, allowing staff time to complete an RFP to secure new long-term consultant agreement for project support.

FISCAL IMPACT/SOURCE OF FUNDING:
Funding for design services is budgeted on a per project basis; therefore, no additional funds are requested at this time.
The cost of professional services and outside consultants are programmed into Capital Improvement Projects on an "as needed" basis. Funding for these services are then included in the respective budget for each individual project, with funding coming from the sources that fund the projects themselves. If approved, the total cost of providing On-Call Architectural & Engineering Design Services in Fiscal Year 2026-2027 will not exceed a maximum of $250,000.
