A DETERMINATION OF CONFORMITY WITH THE GENERAL PLAN FOR THE CITY OF LA HABRA TO PURCHASE A PRIVATELY OWNED PROPERTY LOCATED AT 222 SOUTH EUCLID STREET AS REQUIRED BY GOVERNMENT CODE SECTION 65402

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA):

These projects were reviewed pursuant to the guidelines of the California Environmental Quality Act (CEQA) and determined to be Categorically Exempt pursuant to Section 15061(b)(3) because the projects do not pose a significant effect on the environment.  The acquisition of the properties is exempt from the review under CEQA because the purchase of the properties will not have a significant impact on the environment.  Further environmental review will be conducted on the properties before any construction commences.

DISCUSSION:

The City of La Habra ("City") is interested in acquiring three (3) properties to be used for public purposes.  The first property is the former site of the Women's Club located at 200 West Greenwood Avenue.  The property consists of the entire block on the south side of Greenwood Avenue, east of Lois Street, west of Park Place and north of Rose Avenue.  The property is currently vacant land consisting of 30,938 square feet owned by the La Habra Housing Authority ("Housing Authority").  On June 17, 2019, the City approved the submittal of a grant application to the Statewide Park Development and Community Revitalization Program Grant Funds.  The City was awarded funds to develop a park at this location.  The property is currently zoned R-1c. This use would be consistent with the General Plan land use designation to ensure that existing neighborhoods contain a diverse mix of parks and open spaces that are connected by trails, pathways, and bikeways and are within easy walking distance of residents within the R-1c zone.

The second property under consideration for purchase is located next to the Child Development Center at 209 North Euclid Street.  The parcel is 6,576 square feet and is currently being used as the Child Development Center's parking lot.  The City would like to keep the parcel as parking for Child Development long-term.  In order to maintain this parcel as parking the City needs to purchase the parcel from the Housing Authority.  The property is currently zoned R-1c.  Purchasing the parcel and maintaining it as parking would be consistent with the General Plan land use designation to provide a diversity of uses and services supporting La Habra's residents, such as facilities for civic governance and administration, public safety (police and fire), seniors and youth, community gatherings and comparable activities.

The third property under consideration is located at 222 South Euclid Street.  The parcel is currently vacant and is privately owned.  The parcel is 4,275 square feet and is located to the south of Brio Park.  The parcel is currently zoned R-7.  Should the City purchase the property, the parcel could be used to provide parking for Brio Park.  The purchase would be consistent with General Plan land use designation to provide common recreation open space within residential zones.

In order for the City to purchase the three (3) properties, Government Code Section 65402 requires the Planning Commission to make a determination that the properties are consistent with the General Plan and Zoning Code.  As indicated above the three (3) properties are located within R-1c and R-7 zones and the intended uses are in conformity with existing General Plan land use designations.

FISCAL IMPACT/SOURCE OF FUNDING:

Funds are available in the City's General Fund to cover the cost of the acquisition of the three (3) parcels.

NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES):

The proposed acquisitions have been reviewed pursuant to the requirements of the City's National Pollutant Discharge Elimination System (NPDES) Municipal Permit, the Local Implementation Plan (LIP), and Model Water Quality Management Plan (WQMP).  The acquisition of the properties are exempt by the Water Quality Ordinance.  The subject action only relates to the purchase of the properties.  Further review will be conducted if and when the parcels are planned for development.
