SUBJECT: APPROVE DENIAL OF LIABILITY CLAIM OF DAVID COLLINS FOR PROPERTY DAMAGE

RECOMMENDATION:


That the City Council deny the claim of David Collins in order to set a definite six-month Statute of Limitations date.

DISCUSSION:

David Collins, a La Habra resident, filed a claim on December 10, 2020, in the amount of $6,650 for damage to his property at 351 Capella Avenue.  The claimant alleges that, during a street construction project, vibrations from heavy equipment caused the sewer line to fail in two sections under the sidewalk. He further alleges that the failure of the sewer line under the City sidewalk caused the claimant’s clay sewer pipe to separate, collapse, and become misaligned, allowing soil to fill and clog the sewer pipe.
