| SUBJECT: | APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE PROPOSED MASTER JOINT USE AGREEMENT WITH THE LA HABRA CITY SCHOOL DISTRICT |
RECOMMENDATION:
That the City Council approve and authorize the City Manager to execute the proposed Master Joint Use Agreement with the La Habra City School District.
DISCUSSION:
Over the past year, City and District staff have worked together to develop a proposed Master Joint Use Agreement to enable both agencies to utilize each other’s facilities for mutual benefit. The California Education Code allows both the City and District to provide community recreation programs by sharing facilities that achieve general recreational and educational objectives for both children and adults in the community. The Education Code also allows the District to charge rental fees for use of its facilities; however, by having an approved joint use agreement in place enables the District to reduce or waive rental fees that would otherwise be charged to the City or authorized Youth Sports Affiliates for use of District facilities.
The intention of this agreement is to benefit the community by allowing access to public facilities that will help promote and preserve healthy living and recreational opportunities through both City and District programming. Under the terms and provisions of the proposed agreement, the District will allow the City to utilize District facilities or to facilitate the usage of District facilities for approved youth sports organizations during after school hours and on the weekends. Each entity will submit requests through their respective facility use processes. The proposed agreement also allows the District to utilize City facilities, such as the Community Center or City Hall Atrium and conference rooms for school related banquets, large-scale student testing, and for community and/or staff meetings.
Pursuant to the proposed joint use agreement, the City and District will provide insurance for their own respective use of each other’s facilities and will agree not to charge each other for any rental fees for the use of a given facility. Any direct charges for custodial, support staff, or other event specific insurance will be assessed and paid for by each respective agency. The term of the proposed agreement is for ten years, expiring on March 9, 2031.

FISCAL IMPACT/SOURCE OF FUNDING:
The City and its authorized Youth Sports Affiliate programs will not be charged facility use fees for the use of District facilities; however, both the City, and its affiliates, will be assessed direct charges for District support staff as necessary. The City will also not receive rent for the District's use of its facilities; however, it should be noted that without a Joint Use Agreement in place, both the City and its affiliates could have been assessed up to $75,000 per year for the use of District facilities.
