CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA):
The Seven-Year CIP is a planning document which identifies areas for possible improvements based on the availability of funding. The approval of the Seven-Year CIP is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 21080, (b), (1). Should a specific improvement identified in the Seven-Year CIP be undertaken, an environmental analysis of that project will be performed prior to implementation in accordance with CEQA.
RECOMMENDATION:
That the Planning Commission approve:
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA HABRA FINDING THAT THE PROPOSED FISCAL YEAR 2021-2022 SEVEN-YEAR CAPITAL IMPROVEMENT PROGRAM IS CONSISTENT WITH THE GOALS AND POLICIES OF THE LA HABRA GENERAL PLAN 2035 PURSUANT TO GOVERNMENT CODE SECTIONS 65103 AND 65401.
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA HABRA FINDING THAT THE PROPOSED FISCAL YEAR 2021-2022 SEVEN-YEAR CAPITAL IMPROVEMENT PROGRAM IS CONSISTENT WITH THE GOALS AND POLICIES OF THE LA HABRA GENERAL PLAN 2035 PURSUANT TO GOVERNMENT CODE SECTIONS 65103 AND 65401.
DISCUSSION:
The Public Works Department is submitting to the Planning Commission the proposed Fiscal Year 2021-2022 Seven-Year Capital Improvement Program (7-Year CIP) for a consistency determination with the goals and objectives of the La Habra General Plan 2035, pursuant to Sections 65103 and 65401 of the California Government Code.
A 7-Year CIP plan is a typical timeframe that many Orange County cities use to plan and program infrastructure projects. The multi-year plan is also used for funding purposes to secure adequate funding for the various projects. Annually, the 7-Year CIP plan is updated and presented to the Planning Commission and City Council for review and approval.
Government Code Section 65103 states that the Planning Commission must annually review the 7-Year CIP to ensure planned public improvements are consistent with the overall objectives of the community as detailed in the General Plan.
The projects identified and listed within the Fiscal Year 2021-2022 7-Year CIP may be implemented as funding is available (Attachment 2 – 7-Year Capital Improvement Program, All Projects, FY 2021-2022).
Within the 7-Year CIP, there are three categories of projects:
The following projects have been identified in Fiscal Year 2021-2022* for either design, right-of-way, construction, or deferred to accommodate multi-year funding opportunities (see “Legend” below). Please note that all projects identified as # are considered deferred and are listed so as to identify the project as one that will require funding in a future Fiscal Year. All other projects are planned for FY 2021-2022:

Some of the projects identified above qualify for the use of Measure M2 funds and require a separate list to track the funding. Measure M2 is a half-cent sales tax for transportation improvements approved by voters in 2006. The funds are administered by the Orange County Transportation Authority. A second list has been attached to this agenda report which includes projects listed in Streets and Transportation category above and contains projects that qualify for funding through Measure M2 funds as required by OCTA (Attachment 3 - 7-year Capital Improvement Program, Streets and Transportation Programs, FY2021-2022). This separate list is created to document the appropriate use of the Measure M2 funds.
The Planning Commission is considering this item because Government Code Section 65401 requires that a General Plan consistency finding be made prior to acquiring land for governmental purposes. The proposed improvements are consistent with the goals and policies of the Land Use Element of the La Habra General Plan 2035 which include:

In accordance with California Government Code Sections 65103 and 65401 and based on the goals and policies contained in the La Habra General Plan 2035, a determination of consistency for the FY 2021-2022 Seven-Year Capital Improvement Program to the La Habra General Plan 2035 can be made. Therefore, it is recommended that the Planning Commission adopt a Resolution determining the Fiscal Year 2021-2022 Seven-Year Capital Improvement Program is consistent with the goals and policies of the La Habra General Plan 2035 (Attachment 1 - Resolution).

Within the 7-Year CIP, there are three categories of projects:

Capital Improvement Program FY 2021-2022. There are 24 projects in this category. Some projects are new for this year and some projects (i.e. annual alley improvements) repeat from year to year.

Deferred Capital Improvement Program FY 2021-2022. There are 37 projects in this category. These projects (i.e. storm drain projects) will be constructed when funding becomes available.

In-Progress Capital Improvement Program. There are 41 projects in this category. Some of the projects in this category were approved in the 7-Year CIP FY 2020-2021 and are currently underway either in design or construction. Because of funding challenges or operational constraints, some of these projects will not be completed by June 30, 2021 and that is why they have been included for completion in Fiscal Year 2021-2022.

Therefore, it is recommended that the Planning Commission adopt a Resolution determining the Fiscal Year 2021-2022 Seven-Year Capital Improvement Program is consistent with the goals and policies of the La Habra General Plan 2035 (Attachment 1 - Resolution).
FISCAL IMPACT/SOURCE OF FUNDING:
There is no fiscal impact for the Planning Commission to adopt a resolution finding that the 7-Year CIP is consistent with the goals and policies of the La Habra General Plan 2035.
NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES):
All capital improvement projects address water pollution by regulating point sources that discharge pollutants to waterways.
GENERAL PLAN RELEVANCE:
No specific findings are required to determine the 7-Year CIP consistency with the General Plan. However, the Resolution cites consistency of the 7-Year CIP with applicable goals and policies of the La Habra General Plan 2035 and can be found cited in the discussion section referencing Land Use Elements, Circulation Elements, Conservation Elements, and Open Space Elements.
