RECOMMENDATION:
That the City Council consider and elect/appoint:
A. Mayor for a one-year term (December 2021-December 2022);
B. Mayor Pro Tem for a one-year term (December 2021-December 2022);
C. Chair and Vice Chair for the Successor Agency to the La Habra Redevelopment Agency for a one-year term (December 2021-December 2022);
B. Mayor Pro Tem for a one-year term (December 2021-December 2022);
C. Chair and Vice Chair for the Successor Agency to the La Habra Redevelopment Agency for a one-year term (December 2021-December 2022);
D. Chair and Vice Chair for the Civic Improvement Authority for a one-year term (December 2021-December 2022);
E. Chair and Vice Chair for the Housing Authority for a one-year term (December 2021-December 2022);
F. Delegate and Alternate Representative to the Orange County Sanitation District for a one-year term (December 2021-December 2022);
G. Delegate and Alternate Representative to the Southern California Association of Governments (SCAG) for the purposes of voting in SCAG General Assembly meetings to be held in 2022;
H. Two Councilmembers to serve on the Internal Audit Committee for a one-year term (December 2021-December 2022);
I. Appointment by the Mayor of one Councilmember to serve on the Emergency Preparedness Council as Vice Chair for a one-year term (December 2021-December 2022); and
J. One Citizen-At-Large vacancy on the La Habra Rewards Fund Committee with an indefinite term.
DISCUSSION:
REORGANIZATION
Pursuant to Municipal Code Section 2.12.010, the City Council shall elect a Mayor and Mayor Pro Tem from its own membership at the City Council meeting that is held on the third Monday of each December, or in the event of election years, at a City Council meeting in which the newly elected Councilmembers are sworn in.

CITY COUNCIL APPOINTMENTS TO GOVERNMENTAL AGENCIES AND AUTHORITIES
Members of the City Council also serve as Directors of the City of La Habra Agency and Authorities listed below. Directors have historically reorganized at the first meeting in December, or at a City Council meeting in which the newly elected Councilmembers are sworn-in, and elected a Chairperson and Vice Chairperson for a one-year term. However, with the passage of Ordinance No. 1831 on March 1, 2021, City Council meeting, Directors shall now elect a Chair and Vice Chair at the City Council meeting that is held on the third Monday of each December.
Each City Councilmember receives a $500 monthly salary, while each Housing Authority Member may receive $50 per meeting not to exceed four meetings per month. Members of the Successor Agency to the Redevelopment Agency of the City of La Habra, La Habra Civic Improvement Authority, and La Habra Utility Authority do not receive a stipend.
C. SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY - 1-YEAR TERM
Councilmember Medrano currently serves as Chair and Councilmember Simonian currently serves as Vice Chair. The current one-year term expires December 2021.
D. CIVIC IMPROVEMENT AUTHORITY - 1-YEAR TERM
Councilmember Gomez currently serves as Chair and Councilmember Simonian serves as Vice Chair. The current one-year term expires December 2021.
E. HOUSING AUTHORITY - 1-YEAR TERM
Councilmember Shaw currently serves as Chair and Councilmember Gomez serves as Vice Chair. The current one-year term expires December 2021.
UTILITY AUTHORITY - 1-YEAR TERM
City Council held a public hearing on January 16, 2007, to establish the La Habra Utility Authority, which became effective July 1, 2007. Per the adopted by-laws, the Mayor and Mayor Pro Tem automatically serve as the Chair and Vice Chair of this authority.
APPOINTMENTS OF DELEGATE AND ALTERNATIVE REPRESENTATIVES TO OUTSIDE GOVERNMENTAL AGENCIES
The following City Council appointments as delegate and alternate representatives to various governmental agencies have traditionally been made at the first regular City Council meeting in December, or at a City Council meeting in which the newly elected Council Members are sworn in.
Amended California Code of Regulations 18705.5 allows Councilmembers to make, participate in making, or use their position to influence such a decision if certain conditions are satisfied. To meet this regulation and allow Councilmembers to participate in their own appointment process, the City Council took action on December 3, 2012, to adopt Fair Political Practices Commmission (FPPC) Form 806 and directed staff to post the document on the City’s website. FPPC Form 806 sets forth each appointed position for which compensation is paid, the salary or stipend for each appointed position, the name of the Councilmember who has been appointed to the position, the name of the public official, if any, who has been appointed as an alternate, and the term of the position. FPPC Form 806 has been kept current and maintained on the City website as required by law.
F. ORANGE COUNTY SANITATION DISTRICT - 1-YEAR TERM
Councilmember Espinoza currently serves as Delegate; Councilmember Medrano serves as Alternate. The current one-year term expires December 2021. The State Health and Safety Code Section 4730.65 allows the appointment of any member of the Council to serve on the Board. The delegate to this Board shall receive $212.50 for each day of service attending meetings, not to exceed six days of service per month. However, if the delegate is appointed as Chair by the Orange County Sanitation District Board, the $212.50 per day stipend may be paid for up to 10 days of service per month.
G. SOUTHERN CALIFORNIA ASSOCIATION OF GOVERNMENTS 1-YEAR TERM
Councilmember Espinoza currently serves as Delegate; Councilmember Gomez serves as Alternate for the General Assembly Meetings. On February 7, 2011, the City of La Habra joined the Southern California Association of Governments (SCAG). Each member city shall have one official representative and one alternate in the General Assembly for purposes of voting in the General Assembly meetings. Historically the Annual General Assembly Meetings are held in the early part of each calendar year. The delegate for this board does not receive a stipend and/or salary.
H. INTERNAL AUDIT COMMITTEE - 1-YEAR TERM
The current appointees are Councilmember Espinoza and Councilmember Medrano. Pursuant to generally accepted auditing standards and best practices to ensure open and direct lines of communication with the City’s independent external audit firms, the City established an Internal Audit Committee in Fiscal Year 2007-2008, comprised of two Councilmembers appointed by the City Council. The committee meets, when necessary, with City management staff, Finance Department staff, and the City’s independent external auditors, who presents and discusses annual required audit communications. In addition, the auditors may meet independently with the committee to understand how the City Council exercises oversight of management’s processes for identifying and responding to the risks of fraud in the entity, the internal controls that management has established to mitigate these risks, and to determine their views about the risks of fraud and whether they have knowledge of any actual, suspected, or alleged fraud affecting the entity. The City Council's past practice has been to appoint the Mayor and Mayor Pro Tem to serve as members of the audit committee; however, City Council may choose to appoint other Councilmembers to this committee. The committee members do not receive a stipend and/or salary.
I. EMERGENCY PREPAREDNESS COUNCIL - 1 YEAR TERM
In January 2015 the City Council adopted Ordinance No. 1756 revising La Habra Municipal Code 2.52 “Emergency Services” and establishing the Emergency Preparedness Council (EPC). La Habra Municipal Code Section 2.523.030 provides that the Mayor shall serve as the Chair of the EPC and one additional member of the City Council, as appointed by the Mayor, shall serve as the Vice Chair. The EPC meets quarterly and the members do not receive a stipend and/or salary.
J. LA HABRA REWARDS FUND COMMITTEE - INDEFINITE TERM
There is currently one Citizen-at-Large vacancy on this committee due to the resignation of Jerry Powell on June 28, 2021.
On June 1, 1995 a reward fund was established by the City Council. On July 20, 1995, City Council made appointments to the La Habra Reward Fund Committee and set policy establishing the composition of the committee, which included the Mayor and Mayor Pro Tem serving as City Council representatives, one member from the Executive Management Staff appointed by the City Manager, and two members from the public appointed by City Council. At its May 6, 2013, meeting, City Council appointed Jerry Powell, and at its January 22, 2019, meeting, City Council appointed Ron Woodward as members of the public on the committee. On July 19, 2021, City Manager Sadro appointed Chief Adam Foster as the Executive Management Staff committee member. Since its establishment in 1995, the Committee has met five times on an as needed basis.
Current members of the Reward Fund Committee include:
Two members from the City Council:

One member from Executive Management Staff appointed by City Manager:

Two members from the public appointed by City Council:
· Ron Woodward
· Vacant due to Jerry Powell resignation
Although the Committee rarely meets, staff recommends that City Council review the appointments of the two members of the public for the committee and either reappoint Ron Woodward, who has expressed a willingness to continue serving on the committee, and select one additional member of the public to serve on the committee, or appoint two new members from the general public.
CITY SELECTION COMMITTEE
The City Selection Committee is governed by Government Code Section 50270, which states that the membership of a City Selection Committee shall consist of the Mayor of each city within the County. Section 50271 states that, when the Mayor is unable to attend, he/she shall designate another member of the City Council to attend and vote at the meeting as the Mayor’s representative. The representative can vary from meeting to meeting. At this time it is not necessary to appoint an alternate since the Mayor can designate an alternate on an "as needed" basis at his/her discretion. The delegate for this board does not receive a stipend and/or salary.
FISCAL IMPACT/SOURCE OF FUNDING:
Each member of the City Council receives a monthly stipend of $500 per month from the City General Fund. Housing Authority Directors are budgeted to receive $50 per meeting, not to exceed four meetings per month ($200/month total), funded from the Housing Authority budget.
