RECOMMENDATION:
That the City Council deny the claims of Thomas Cherry and Yolanda Cherry in order to set a definite six-month Statute of Limitations date.
DISCUSSION:
On November 10, 2021, the City was served with claims filed by an attorney on behalf of Thomas Cherry and Yolanda Cherry, both City of La Mirada residents, for an unspecified amount. The claims allege that on May 13, 2021, Ms. Cherry was involved in a traffic collision due to signal outage at the intersection of Imperial Highway and Beach Boulevard. As the location of the alleged incident is controlled and maintained by Caltrans, the claims were tendered to Caltrans for handling.
