RECOMMENDATION:
That the City Council deny the claim of Kwang Kim in oder to set a definite six-month Statute of Limitations date.
DISCUSSION:
On September 29, 2021, Mr. Kwang Kim, a La Habra resident, filed a property damage claim for an unspecified amount. The claim alleges that on September 8, 2021, City workers were paving the public alley adjacent to his home at 605 East Erna Avenue when a construction vehicle collided with the claimant’s fence and caused damage. It was determined that the work performed was done by an outside contractor. The claim was tendered to the contractor who then settled with the claimant.
