RECOMMENDATION:
That the City Council deny the claim of Alejandro and Patricia Tinoco in order to set a definite six-month Statute of Limitations date.
DISCUSSION:
On January 10, 2022, an attorney representing Alejandro and Patricia Tinoco filed a claim in the death of their son, Dustin Tinoco. The claim alleges that on August 2, 2021, Dustin Tinoco (decedent) was driving a motorcycle when he was involved in a traffic collision with another vehicle on Beach Boulevard (a state highway). The claimants allege that the roadway where the incident occurred constituted a dangerous condition. The claimants were notified that the location of the alleged incident is under the jurisdictional control of CalTrans.
