RECOMMENDATION:
That the City Council:
A. Consider and approve the first reading of ORDINANCE NO. ______ ENTITLED: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, AMENDING CHAPTER 2.28 (COMMUNITY SERVICES COMMISSION) OF THE LA HABRA MUNICIPAL CODE REGARDING THE COMMUNITY SERVICES COMMISSION; and
B. Approve proposed terms for recently appointed Commissioners.
DISCUSSION:
At its April 4, 2022 meeting, the City Council considered and approved the appointment of individuals to both the City Planning Commission, as well as the City's Community Services Commission. As a result of the appointment process, the City Council opted to not fill two vacant Community Services Commission seats and directed staff to initiate the process to reduce the size of the Community Services Commission from seven members to five so that it would be consistent in size with the City's other standing commissions and committees. Accordingly, staff has drafted the attached ordinance that would modify the relevant sections of Chapter 2.28 of the La Habra Municipal Code to reduce the size of the Community Services Commission.
The specific recommended changes are in Section 2.28.010 and Section 2.28.020, which are identified in bold and italics below:
Chapter 2.28 COMMUNITY SERVICES COMMISSION
2.28.010 Establishment—Membership.
There is hereby created a community services commission for the city which shall be known as “La Habra Community Services Commission.” The community services commission shall consist of seven five members appointed by the city council. Commissioners shall be residents of the city and appointments shall be made on the basis of interest and qualification of applicants.
2.28.020 Terms.
The terms of the seven five members of the community services commission shall be for a period of three years. All terms shall expire on March 31st and terms shall be staggered so that the terms of no more than three members shall expire each year. Each member shall serve until his/her successor is appointed by the city council.
Furthermore, at its April 4, 2022, Council approved the appointment of four individuals to fill four of the six Community Services Commissioners seats that had expired on March 31, 2022; however, City Council did not indicate which terms each appointed Commissioner should fill in order to keep staggered terms. Based on their originally expiring terms and COVID related extensions of prior terms, staff recommends that the City Council approve the following terms for the identified Commissioners:
- Teresa Kempker - 2-year term ending March 31, 2024
- Richard Rojas - 2-year term ending March 31, 2024
- Denise Schmidt - 3-year term ending March 31, 2025
- Gabriela Garcia - 3-year term ending March 31, 2025
FISCAL IMPACT/SOURCE OF FUNDING:
Community Services Commissioners receive a $50 per month stipend for their service. By reducing the size of the Community Services Commission from seven members to five, the City's General Fund will save $1,200 per year.
