RECOMMENDATION:
That the City Council deny the claim of Ms. Carmela Stuart in order to set a definite six-month Statute of Limitations date.
DISCUSSION:
Ms. Carmela Stuart, a City of La Habra resident, filed a property damage claim on June 7, 2023, in the amount of $1,771.84 for reimbursement to replace one tire, repair a rim and front bumper of her vehicle. Ms. Stuart alleges that on March 30, 2023, while attempting to parallel park along the east curb line along Walnut Street, her front tire became lodged in a pothole due to uneven pavement during a street resurfacing project causing damage to her vehicle. This claim was tendered to the City's contractor conducting street paving work at that location.
