RECOMMENDATION:
That the City Council deny the claim of Ms. Cari McCormick in order to set a definite six-month Statute of Limitations date.
DISCUSSION:
On June 28, 2023, the City of La Habra received a class action claim for a discrimination complaint against CalPERS from an attorney representing Ms. Cari McCormick. The claimant, Ms. Cari McCormick, is not a resident of the City of La La Habra nor a current or former employee of the City, but rather, is a former employee of Lake County, CA and was evidently enrolled in CalPERS while working for Lake County. The claim alleges that since Ms. McCormick was hired over the age of 40, her CalPERS disability benefits were unfairly reduced compared to someone who would have been hired at a younger age and, therefore, alleges age discrimination. The claimant names 1,540 other public entities as “List of Potential Defendants,” which includes the City of La Habra.
