RECOMMENDATION:
That the City Council approve the Notice of Completion for the Annual Sidewalk and Access Ramp Improvements, Fiscal Year 2021-22 and Fiscal Year 2022-23, City Project No. 1-R-22, and authorize staff to file the Notice of Completion for recordation.
DISCUSSION:
On May 5, 2023, the City Council awarded a construction contract to Onyx Paving Company, Inc., of Anaheim, California, in the amount of $447,600, which included a 20% contingency, for the construction of the Annual Sidewalk and Curb Access Ramp Improvements, Fiscal Year 2021-22 and Fiscal Year 2022-23, City Project No. 1-R-22 ("Project"). The Project included concrete improvements, such as reconstruction of approximately 18,000 square feet of sidewalks, 670 lineal feet of curb and gutters, reconstruction of two Americans with Disabilities (ADA) curb ramps, 3,000 square feet of drive approaches, and incidental tree root pruning and tree removals. Additional work, consisting of the removal of approximately 6,400 square feet of deficient sidewalks and the construction of full-width (9 feet) sidewalks on the west side of Macy Street, adjacent to Macy Elementary School, was also completed.
Staff conducted a final inspection and found that the work was completed in accordance with the Project's contract specifications and City standards. Upon acceptance of the Project by the City Council, staff will file a Notice of Completion (Attachment 1) for recordation at the Orange County Clerk-Recorder’s Office.

FISCAL IMPACT/SOURCE OF FUNDING:
The total construction cost for the project, including the extra work, was $446,040.50, or $1,559.50 less than the approved purchase order amount of $447,600. Therefore, there are sufficient funds to release the retention payment and file the Notice of Completion.
