SUBJECT:
APPROVE AMENDMENT NO. 2 TO AGREEMENT FOR SERVICES BETWEEN THE CITY OF LA HABRA AND TETRA TECH BAS, INC.

RECOMMENDATION:


That the City Council:
A. Approve Amendment No. 2 to Agreement for Services between the City of La Habra and Tetra Tech BAS, Inc. for the Vista Grande Park Improvement Project, City Project No, 1-P-22;

B. Authorize the City Manager to execute Amendment No. 2 to Agreement for Services between the City of La Habra and Tetra Tech BAS, Inc. for the Vista Grande Park Improvement Project, City Project No, 1-P-22; and,

C. Authorize staff to issue a Purchase Order in the amount not to exceed $150,000 to Tetra Tech BAS, Inc. to provide design support during construction of the Vista Grande Park Improvement Project, City Project No. 1-P-22.

DISCUSSION:

On March 18, 2019, the City entered into an Agreement with Tetra Tech BAS, Inc. (Tetra Tech), in the amount of $727,888, to provide engineering and design services for the Vista Grande Park Improvement Project, City Project No, 1-P-22. The proposal included a variety of services including the development of two design alternatives for the park, preliminary engineering, environmental studies, project plans, specifications, contract documents, construction engineering, and inspection services. Since the project was in the preliminary design phase at that time and staff was still pursuing grant funding for the project, staff eliminated a portion of the work from the agreement related to Project Management, Coordination, Bidding and Construction Support Services (Tasks 1 through 3), originally quoted at $157,985, with the intent of securing those services at a later date when the project was ready to proceed. On April 20, 2020, the City Council approved Amendment No.1 to the Agreement with Tetra Tech to extend the term of the contract until completion of the work and final acceptance by the City. There was no financial impact as a result of this amendment. 

Now that the project is fully funded and ready to commence, and at the City's request, Tetra Tech has submitted a proposal to provide consulting and design support services during the construction of the Vista Grande Park improvements, in an amount not to exceed $150,000.  Amendment No. 2 to the agreement provides the scope of work for these construction support services, including technical assistance, in order to verify that the project is being constructed in accordance with the approved plans and specifications. 

The new consulting services will include, but are not limited to:
  • Reviewing contractor submittals
  • Responding to requests for information (RFIs)
  • Review drawings for conformance with plans/specifications
  • Provide assistance with project permitting
  • Other services as needed, within the authorized budget
 

Staff has reviewed Tetra Tech's proposal and the proposed Amendment No. 2 that the City Attorney's office has drafted, and recommends that City Council approve Amendment No. 2 to Agreement for Services between the City and Tetra Tech and to authorize staff to issue a purchase order to Tetra Tech for this additional work, in an amount not to exceed $150,000.

FISCAL IMPACT/SOURCE OF FUNDING:

On October 16, 2023, City Council approved a total project budget for services associated with the development of Vista Grande Park in the amount of $12,797,497, which includes funding for construction, construction management, construction quality assurance, and contract inspection services associated with the Project. Sufficient funding is available in the approved budget to fund the proposed additional services from Tetra Tech; therefore, no additional funds are being requested at this time.
