APPROVE NOTICE OF COMPLETION FOR THE ANNUAL ARTERIAL STREET REHABILITATION, FISCAL YEAR 2019-2020, CITY PROJECT NO. 5-R-19

RECOMMENDATION:


That the City Council approve the Notice of Completion for the Annual Arterial Street Rehabilitation, Fiscal Year 2019-2020, City Project No. 5-R-19, and authorize staff to submit the notice for recordation. 

DISCUSSION:

On April 18, 2022, the City Council awarded a construction contract to EBS General Engineering, Inc. of Corona, California in the amount of $2,144,751, for the Annual Arterial Street Rehabilitation, Fiscal Year 2019-2020, City Project Number 5-R-19. On September 19, 2022, the City Council approved additional work on Euclid Street, Lambert Road, and Beach Boulevard, increasing the Purchase Order amount by $642,250 from $2,573,701 to $3,215,951.

The project scope included approximately 3.5 centerline miles of roadway reconstruction throughout various arterial streets in the City, and included mobilization, preparation and implementation of storm water "best management practices," traffic control, concrete sidewalk, curb ramp, curb and gutter, and driveway rehabilitation, pavement rehabilitation, striping and markings, and all associated work as identified on the construction drawings.

Staff conducted a final inspection and found that the work was completed in accordance with the project plans, specifications, and City of La Habra standards. Upon acceptance of the project by the City Council, staff will file a Notice of Completion (Attachment 1) for recordation at the Orange County Clerk-Recorder's Office. Before and after pictures of the project are included as Attachment 2. 

FISCAL IMPACT/SOURCE OF FUNDING:

All contract work for this Project has been completed, and to date, the City has paid EBS General Engineering, Inc. a total of $2,618,227.72 for the completed work. It should be noted that a portion of the project cost remains in disagreement between the City and EBS. Staff is currently working with the City Attorney's office to negotiate a resolution with EBS; however, in order to release the contract retention payment, as provided for in the contract, the City must file a Notice of Completion for the completed work.

The cost of the completed and approved work, in addition to the costs that are pending negotiation, are expected to be within the $3,215,951 adopted budget for this project; therefore, sufficient funds are available to cover the final cost of the project, which includes the release of the contract retention payment and the anticipated amounts pending negotiation.
