APPROVE AND AUTHORIZE THE MAYOR TO EXECUTE A REVISED AMENDMENT #4 TO THE FIRE SERVICES AGREEMENT BETWEEN THE CITY OF LA HABRA AND THE LOS ANGELES COUNTY FIRE DEPARTMENT

RECOMMENDATION:


That the City Council approve and authorize the Mayor to execute a revised Amendment #4 to the Agreement for Services between the City of La Habra and the Los Angeles County Fire Department (LACoFD).

DISCUSSION:

At the City Council meeting on August 21, 2023, staff discussed the history of the mutually beneficial cost-sharing agreement with LACoFD for fire services and the negotiations following LACoFD's announcement that they would no longer be able to support the prior funding model that had been in place for 20 years. Based on the negotiation position taken by LACoFD, if the City desired to have LACoFD continue providing service in La Habra, the City would have to assume the full fee for services, essentially doubling the cost from approximately $11 million to almost $22 million for four stations. Following months-long negotiations, the City and LACoFD were able to negotiate the following terms: 

Amendment #3:
  • The effective date would be prior to October 1, 2023, and ended the City's current 10-year contract extension on June 30, 2024, versus the previous termination date in February 2025.
  • Although LACoFD had initially proposed to terminate the existing contract extension early and renegotiate a higher fee structure for the City that would have taken effect immediately, staff was able to keep the current fee sharing arrangement in place through June 30, 2024, coinciding with the end of FY 23/24.
  • As a cost savings measure, the City agreed that LACoFD could remove fire resources at Station 193, thus closing that facility as one of the City's four fire stations. LACoFD removed their fire resources from Station 193 by October 1, 2023. Once fire resources were removed from the location, the City began implementing a plan to utilize the former fire station location on Idaho Street to house and dispatch ambulances and potentially use the facility for other public safety purposes.
  • The City agreed that LACoFD could revise its staffing model for Station 194 from a four-person paramedic assessment engine to a three-person paramedic assessment engine as an additional cost-savings measure.
Amendment #4:
  • The effective date will be July 1, 2024.
  • The term of the agreement will extend for 10 years from the effective date, through June 30, 2034.
  • The City will agree to fund 100 percent of fire resource costs at Station 191, and continue funding 100 percent of fire resource costs at Station 192.
  • LACoFD will agree to upgrade its paramedic capabilities at Station 192 from the current Paramedic Assessment Engine to a full Paramedic Engine.
  • Despite LACoFD's prior insistence that the City pay 100 percent of fire resource costs at all fire stations, LACoFD has agreed to a cost sharing arrangement that would evenly share the fire resources and related costs for Station 194.
  • LACoFD will be required to provide a two-year written termination notice to the City, rather than the current one-year requirement, in the event that they consider unilateral contract termination again in the future.
  • The City will have the right to terminate the agreement at any time by providing a one-year written notice to LACoFD.
Amendment #3 was entered into and effective on October 1, 2023. Since that time, staff has been working with LACoFD to finalize Amendment #4. The terms above have been included; however, there are some proposed amendments to the original agreement that Staff is recommending Council approve as part of Amendment #4. In discussions regarding Amendment #4 with LACoFD staff, they initially expressed to the City that they planned to remove the Annual Fee Limitation clause completely from the original agreement, meaning there would be no cap on how much LACoFD could raise the City's annual fire service costs each year. City staff indicated that this was not an acceptable demand, as it would create a significant amount of risk and uncertainty in the City's future years' costs and negatively impact the City's ability to effectively budget potential annual cost increases. After several months of additional negotiations, staff was able to retain an Annual Fee Limitation in place, slightly modifying the Annual Fee Limitation formula in years seven through ten by taking the average of the preceding four years' percentage increases plus one percent (1%) instead of the average preceding five years' increases plus 1% in Actual Annual Fee.

In discussions with LACoFD staff regarding Amendment #4, City and LACoFD staff also clarified additional areas of the original 2005 agreement and prior contract amendments. The new, revised proposed language in Amendment #4 would:
  • Temporarily cease the Annual Fee Limitation in FY 2024-2025 due to the underlying change in fee structure and service levels beginning July 1, 2024, which will drastically raise the City's costs for fire service. After the first year of the new contract extension, and through the sixth year, the annual cost for fire services will be capped at no more than 4%. In the seventh through tenth years of the extended term of the agreement, the Annual Fee Limitation shall be the average of the immediately preceding four years' percentage increases in the Actual Annual Fee plus one percent (1%), instead of the average preceding five years' percentage plus one percent (1%), as provided for in the original agreement.
  • The new language also clarifies the roles and responsibilities for the landscaping maintenance at each of the remaining three fire stations.
  • The amendment also includes language ensuring that the City retains its ability to receive reimbursement or credit for any and all furniture, tools, furnishings and related fire equipment previously owned by the City and transferred to LACoFD from the now-closed Station 193, or any other stations currently being utilized by LACoFD, as well as the return of all apparatus and vehicles to the City, of a comparable type, condition, age and quantity as were transferred to LACoFD by the City when they initiated service as part of the original fire services agreement.

FISCAL IMPACT/SOURCE OF FUNDING:

There is no immediate impact to the Fiscal Year 2023-24 budget. Schedule 2-E in the attached agreement shows the cost for fire service to the City's General Fund in FY 2024-25 will be $14,425,210 for three fire stations. This new annual cost is approximately $4.4 million higher per year for three fire stations than what the City had previously budgeted in FY 2022-23 for four fire stations, when negotiations first began with LACoFD for the new 10-year contract extension. This increased cost for fire services will be included in proposed FY 2024-25 budget for Council review and consideration.

It is also consistent with the following City Council Goals and Objectives:
Goal 2, Objective B: Regularly review and evaluate programs, services, and professional agreements to assess effectiveness and identify opportunities for greater efficiencies and cost containment.
Goal 6, Objective E: Build and maintain partnerships and collaborations with other local government agencies, the business community, local non-profit organizations, and the faith-based community
Goal 7, Objective C: Provide and maintain quality public services for our residents, businesses, and visitors
