A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA HABRA, CALIFORNIA, FINDING THAT THE PROPOSED FISCAL YEAR 2024-2025 SEVEN-YEAR CAPITAL IMPROVEMENT PROGRAM IS CONSISTENT WITH THE LA HABRA GENERAL PLAN 2035

The Public Works Department is submitting to the Planning Commission the proposed Fiscal Year 2024-2025 Seven-Year Capital Improvement Program (7-Year CIP) for a consistency determination with the goals and objectives of the La Habra General Plan 2035, pursuant to Sections 65103 and 65401 of the California Government Code.

A 7-Year CIP plan is a typical timeframe that many Orange County cities use to plan and program infrastructure projects. The multi-year plan is also used for funding purposes to secure adequate funding for the various projects. Annually, the 7-Year CIP plan is updated and presented to the Planning Commission and City Council for review and approval.

Government Code Section 65103(c) requires the Planning Commission to annually review the 7-Year CIP to ensure planned public improvements are consistent with the overall objectives of the community as detailed in the General Plan. The projects identified and listed within the 7-Year CIP may be implemented as funding is available.

Government Code Section 65401 requires the Planning Commission to review and report to the City Council regarding conformity of the CIP with the General Plan.

Within the 7-Year CIP there are three categories of projects (Attachment 2: CIP, All Projects, FY 2024-2025):

1. New Capital Improvement Program FY 2024-2025: There are a total of 18 new projects in this category.  Annual recurring projects are included in this list (i.e. annual alley improvements, streets, sidewalks, etc.).
 

 

2. In-Progress Capital Improvement Program: There are 34 projects in-progress in this category.  Some projects in this category were approved in the 7-year CIP FY 2023-2024 and/or previous fiscal years, and are currently underway; either in the design or construction phase,  Because of funding challenges, operational constraints, and/or projects that are considered "multi-year" projects, these projects continue to be programmed for completion in the new fiscal year.
 

 

3. Deferred Capital Improvement Program: There are 56 projects in this category.  These projects (i.e. storm drain projects, facility rehabilitation, etc.) will be implemented when funding becomes available.

 

The majority of the proposed street and transportation improvements projects identified in the Capital Improvement Program FY 2024-2025 qualify for the use of Measure M2 funds and require a separate list to track the funding. Measure M2 is a half-cent sales tax for transportation improvements approved by voters in 2006. The funds are administered by the Orange County Transportation Authority. This list has been attached to this agenda report which includes projects listed in Streets and Transportation category above and contains projects that qualify for funding through Measure M2 funds as required by OCTA (Attachment 3 - OCTA M2 7-Year CIP). This separate list is created to properly document the appropriate and eligibility use of the Measure M2 funds.

The Fiscal Year 2023-2024 Budget for the Community and Economic Development assumes the costs associated with the Planning Commission's review and adoption of a resolution finding that the 7-Year CIP is consistent with the goals and policies of the La Habra General Plan 2035.

All capital improvement projects address water pollution by regulating point sources that discharge pollutants to waterways.

The Planning Commission is considering this item because Government Code Sections 65103 and 65401 requires that a General Plan consistency finding be made regarding the CIP.

The proposed improvements included in the 7-Year CIP are consistent with the goals and policies of the Land Use Element of the La Habra General Plan 2035 which include:

In accordance with California Government Code Sections 65103 and 65401 and based on the goals and policies contained in the La Habra General Plan 2035, a determination of consistency for the FY 2024-2025 Seven-Year Capital Improvement Program to the La Habra General Plan 2035 can be made. Therefore, it is recommended that the Planning Commission adopt a Resolution determining the Fiscal Year 2024-2025 Seven-Year Capital Improvement Program is consistent with the goals and policies of the La Habra General Plan 2035.

In addition to the aforementioned goals and policies of the General Plan, the FY 2024-2025 Seven-Year Capital Improvement Program implements the following City Council Goals and Objectives:

Goal 3 – Maintenance and improvement of city infrastructure
Objective A: Enhance physical and digital security at sensitive city-owned sites, such as child care facilities, public safety facilities, and water and maintenance sites.
Objective B: Maintain and upgrade city buildings, facilities, and parks
Objective C: Identify and pursue funding opportunities to design and construct recreational trails as part of the oc loop bicycle/pedestrian trail system
Objective D: Maintain and upgrade the city’s traffic signal system

Goal 7 – Integration of excellence in city operations
Objective C: Provide and maintain quality public services for our residents, businesses, and visitors
