CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA):
The Seven-Year Capital Improvement Program (CIP) is a planning document that identifies areas for possible improvements based on the availability of funding. It does not commit the City to implementing any specific project or project design. A finding that the proposed 7-Year CIP is consistent with the La Habra General Plan 2035 is an administrative activity of the City that will not result in direct or indirect physical changes to the environment. Therefore, the determination of General Plan consistency for the 7-Year CIP is not a “project” and is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378(b)(5). Should a specific improvement identified in the Seven-Year CIP be undertaken, an environmental analysis of that project will be performed prior to implementation in accordance with CEQA.

DISCUSSION:
A 7-Year CIP plan is a typical timeframe that many Orange County cities use to plan and program infrastructure projects. The multi-year plan is also used for funding purposes to secure adequate funding for the various projects. Annually, the 7-Year CIP plan is updated and presented to the Planning Commission and City Council for review and approval.
Government Code Section 65103(c) requires the Planning Commission to annually review the 7-Year CIP to ensure planned public improvements are consistent with the overall objectives of the community as detailed in the General Plan. The projects identified and listed within the 7-Year CIP may be implemented as funding is available.
Government Code Section 65401 requires the Planning Commission to review and report to the City Council regarding conformity of the CIP with the General Plan.
Within the 7-Year CIP there are three categories of projects (Attachment 2: CIP, All Projects, FY 2024-2025):

In accordance with California Government Code Sections 65103 and 65401 and based on the goals and policies contained in the La Habra General Plan 2035, a determination of consistency for the FY 2024-2025 Seven-Year Capital Improvement Program to the La Habra General Plan 2035 can be made. Therefore, it is recommended that the Planning Commission adopt a Resolution determining the Fiscal Year 2024-2025 Seven-Year Capital Improvement Program is consistent with the goals and policies of the La Habra General Plan 2035.
In addition to the aforementioned goals and policies of the General Plan, the FY 2024-2025 Seven-Year Capital Improvement Program implements the following City Council Goals and Objectives:
Goal 3 – Maintenance and improvement of city infrastructure
Objective A: Enhance physical and digital security at sensitive city-owned sites, such as child care facilities, public safety facilities, and water and maintenance sites.
Objective B: Maintain and upgrade city buildings, facilities, and parks
Objective C: Identify and pursue funding opportunities to design and construct recreational trails as part of the oc loop bicycle/pedestrian trail system
Objective D: Maintain and upgrade the city’s traffic signal system
Goal 7 – Integration of excellence in city operations
