| SUBJECT: | DULY NOTICED PUBLIC HEARING TO CONSIDER THE PROPOSED SUBSTANTIAL AMENDMENT TO THE CITY OF LA HABRA’S COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM ANNUAL ACTION PLAN FOR FISCAL YEAR 2021-2022 AND FISCAL YEAR 2024-2025

RECOMMENDATION:
That the City Council:
A. Hold a hearing and receive public comments; and,
B. APPROVE AND ADOPT RESOLUTION NO. CC 2024-__ ENTITLED: A RESOLUTION OF THE CITY OF LA HABRA, CALIFORNIA, APPROVING THE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) SUBSTANTIAL AMENDMENT TO THE ANNUAL ACTION PLAN FOR FISCAL YEAR 2021-2022 AND FISCAL YEAR 2024-2025.
DISCUSSION:
The Fiscal Year (FY) 2021-2022 Annual Action Plan was adopted by the City Council on April 19, 2021. The City's Citizen Participation Plan requires the City Council to approve, by resolution, a Substantial Amendment to the Annual Action Plan whenever a "substantial" change is proposed. For the purpose of the Annual Action Plan, a “substantial change” is defined as:
- Addition of a new project not previously identified in the Action Plan, without regard to funding source;
- Cancelation of an existing project identified in the Action Plan, without regard to funding source;
- A change that significantly alters the purpose, scope, location or beneficiaries of a project; or,
- Changes in the use of CDBG funds from one eligible project to another eligible project meeting the set dollar amount thresholds.
The Substantial Amendment process allows the public an opportunity to provide input on proposed changes to the use of CDBG funding. In order to comply with the City’s approved Citizen Participation Plan and Consolidated Plan implementing regulation 24 CFR 91.105, a Substantial Amendment must be made available to the public for a 30-day review period, followed by a public hearing before City Council that allows for additional input and comments prior to City Council's consideration for approval of the Substantial Amendment.
The proposed Substantial Amendment was made available for public review and comment from September 22, 2024, through October 21, 2024. A notice (Attachment 1) regarding this public review period was advertised in the Orange County Register, and the proposed Substantial Amendment was made available on the City's website, and at the City's Community Center facility, City Hall, and the La Habra Branch of the Orange County Public Library. At the time of the preparation of this report, staff had not received any public comments regarding the proposed Substantial Amendment.
If approved by City Council, the proposed Substantial Amendment would cancel the FY 2021-2022 Alley Improvement Program ($150,377) previously approved for FY 2021-2022. The CDBG funding for the Alley Improvement Program was canceled because the City's Public Works Department utilized another source of eligible funding for the FY 2021-2022 Alley Program.
If approved, the proposed Substantial Amendment would add a new program: the FY 2024-2025 Rehabilitation of an Existing Apartment at Park La Habra Mobile Home Park Program. Park La Habra is a mobile home park that is owned by the City's Housing Authority and serves a low-income population. The subject apartment is a two-bedroom unit, located adjacent to and above the mobile home park's clubhouse. Earlier this year the unit was inspected by staff and found to be in need of complete rehabilitation. The subject apartment is proposed to be converted to a three-bedroom unit in order to accommodate a larger (four or more persons) low-income household. The proposed improvements would modify bedroom and bathroom sizes, without increasing the overall size of the original structure. In addition, as part of the Residential Rehabilitation Program, the unit will be tested for lead-based paint and asbestos and remediated as necessary. If approved, the proposed Substantial Amendment would allocate $300,000 toward the rehabilitation of the apartment in FY 2024-2025.

FISCAL IMPACT/SOURCE OF FUNDING:
If the proposed Substantial Amendment is approved, the Community Development Block Grant (CDBG) funds that are proposed to be canceled from the FY 2021-2022 Alley Improvement Program ($150,377) would be allocated to the proposed FY 2024-2025 Rehabilitation of an Existing Apartment at Park La Habra Mobile Home Park Program. In addition, the proposed program would receive $149,623 from unallocated CDBG funds, for a total program cost of $300,000. There will be no adverse impact to the General Fund if the proposed Substantial Amendment is approved.
