SUBJECT: DULY NOTICED PUBLIC HEARING TO REVIEW THE FISCAL YEAR 2025-2026 SEVEN-YEAR CAPITAL IMPROVEMENT PROGRAM FOR CONSISTENCY WITH THE CITY OF LA HABRA GENERAL PLAN 2035

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA):

A finding that the Seven-Year Capital Improvement Program (7-Year CIP) is consistent with the La Habra General Plan 2035 is not subject to the provisions of the California Environmental Quality Act (CEQA) because such a finding is not a project pursuant to Section 15378(b)(5) of the CEQA Guidelines. Section 15378(b)(5) of the CEQA Guidelines provides that the term "project" does not include administrative activities of governments that will not result in direct or indirect physical changes to the environment. The 7-Year CIP is a planning document that identifies areas for possible improvements based on the availability of funding. It does not commit the City to implementing any specific project or project design. A finding that the proposed 7-Year CIP is consistent with the La Habra General Plan 2035 is an administrative activity of the City that will not result in direct or indirect physical changes to the environment. Therefore, the determination of General Plan consistency for the 7-year CIP is not a "project" pursuant to CEQA Guidelines Section 15378(b)(5). Should a specific improvement identified in the Seven-Year CIP be undertaken, an environmental analysis of that project will be performed prior to implementation in accordance with CEQA.

RECOMMENDATION:

That the Planning Commission adopt and approve:

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA HABRA, CALIFORNIA, FINDING THAT THE PROPOSED FISCAL YEAR 2025-2026 SEVEN-YEAR CAPITAL IMPROVEMENT PROGRAM IS CONSISTENT WITH THE LA HABRA GENERAL PLAN 2035

DISCUSSION:

The City of La Habra General Plan 2035 was adopted on January 21, 2014, and last amended on January 16, 2024 (the "General Plan"). California Government Code Section 65103(c) requires the Planning Commission to annually review the City's Capital Improvement Program ("CIP") for their consistency with the General Plan. California Government Code Section 65401 requires the Planning Commission to review and report to the City Council regarding conformity of the CIP with the General Plan. The attached resolution has been prepared to report these findings to City Council (Attachment 1).

The Public Works Department is submitting the proposed Fiscal Year 2025-2026 Seven-Year CIP (FY 25/26 7-Year CIP) to the Planning Commission to review and report to City Council whether the FY 25/26 7-Year CIP is consistent with the General Plan, pursuant to Sections 65103 and 65401 of the California Government Code. The proposed FY 25/26 7-year CIP is provided as Attachment 2 to this staff report.

The FY 25/26 7-Year CIP plan covers a typical timeframe that many other Orange County cities use to plan and program infrastructure projects. This multi-year plan is also used for funding purposes to secure adequate funding for the various projects. Annually, the 7-Year CIP plan is updated and presented to the Planning Commission and City Council for review and approval. The projects identified and listed within the FY 25/26 7-Year CIP may be implemented as funding is available.  Within the FY 25/26 7-Year CIP there are three categories of projects:
  1. FY 25/26 In-Progress CIP: There are 28 projects in-progress in this category. Some projects in this category were approved in the FY 24/25 7-Year CIP and/or previous fiscal years, and are currently underway, either in the design or construction phase. Because of funding challenges, operational constraints, and/or projects that are considered "multi-year" projects, these projects continue to be programmed for completion in the new fiscal year.
  2. FY 25/26 Proposed New CIP: There are a total of 37 new projects in this category. Annual recurring projects are included in this list (i.e. annual alley improvements, streets, sidewalks, etc.).
  3. FY 25/26 Deferred Capital Improvement Program: There are 36 projects in this category. These projects (i.e. storm drain projects, facility rehabilitations, etc.) will be implemented when funding becomes available.
Measure M2 is a half-cent sales tax for transportation improvements approved by voters in 2006. The majority of the proposed street and transportation improvement projects identified in the FY 25/26 7-Year CIP qualify for the use of Measure M2 funds. The Orange County Transportation Authority (OCTA) administers these funds and requires a separate list to track the funding for these projects (see Attachment 3). This separate list is created to properly document the appropriate and eligible use of the Measure M2 funds.

FISCAL IMPACT/SOURCE OF FUNDING:

The Fiscal Year 2024-2025 Budget for the Community and Economic Development Department assumes the costs associated with the Planning Commission's review and adoption of a resolution finding that the FY 25/26 7-Year CIP is consistent with the goals and policies of the La Habra General Plan.

NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES):

All capital improvement projects address water pollution by regulating point sources that discharge pollutants to waterways.

GENERAL PLAN RELEVANCE/CITY COUNCIL GOALS & OBJECTIVES:

Staff have reviewed the FY 25/26 7-Year CIP against the General Plan's goals and policies and recommends that the Planning Commission find the FY 25/26 7-Year CIP consistent with the following Land Use (LU) goals and policies of the General Plan:

As identified above, in accordance with California Government Code Section 65103 and 65401, and based on the goals and policies contained in the General Plan, the Planning Commission can determine and report to the City Council that the FY 25/26 7-Year CIP is consistent with the General Plan. Therefore, it is recommended that the Planning Commission adopt the attached Resolution determining that the FY 25/26 7-Year CIP is consistent with the goals and policies of the General Plan.

In addition to the aforementioned goals and policies of the General Plan, the FY 2025-2026 Seven-Year Capital Improvement Program implements the following City Council Goals and Objectives:

Goal 3 -- Maintenance and improvement of city infrastructure
Objective A: Enhance physical and digital security at sensitive city-owned sites, such as child care facilities, public safety facilities, and water and maintenance sites
Objective B: Maintain and upgrade city buildings, facilities, and parks
Objective G: Identify and pursue funding opportunities to design and construct recreational trails as part of the oc loop bicycle/pedestrian trail system
Objective H: Maintain and upgrade the city's traffic signal system

Goal 7 -- Integration of excellence in city operations
Objective C: Provide and maintain quality public services for our residents, businesses, and visitors
