APROVE BUDGET AMENDMENT FOR VIN SCULLY CENTENNIAL PARK IMPROVEMENT PROJECT, CITY PROJECT NO. 2-P-22 

RECOMMENDATION:

 
That the City Council:
A. Approve a Budget Amendment to the Vin Scully Centennial Park Improvement Project, City Project No. 2-P-22, and appropriate $800,000.00 of available, unencumbered Park Acquisition Funds to fund additional park features; and, 

B. Approve a Purchase Order increase in an amount not-to-exceed $174,480.00 to Z&K Consultants to fund their expanded construction management, quality assurance, and inspection services for the Project.

DISCUSSION:

On October 16, 2023, the City Council approved a construction contract and a project budget in the amount of $12,797,497 for the development of the Vin Scully Centennial Park Improvement Project, City Project No. 2-P-22 ("Project"). Park amenities include: open play fields, a walking and running path, exercise stations, roadways and parking areas, playground equipment, an art wall, a food truck circle, an amphitheater, a drought tolerant demonstration garden, landscaping/irrigation, installation of stormwater drainage basins, tree planting, a gazebo, a volleyball court, a basketball/futsal court, picnic tables and other park amenities. The project will also make modifications to the landfill gas control system and the installation of a new landfill cap to meet regulatory agency requirements such as the California Regional Water Board (Santa Ana RWQCB), CalRecycle, and the local environmental enforcement agency (LEA).  The installation of a new pre-fabricated restroom was part of the original design package for the park project; however, due increasing costs and budgetary constraints, staff reevaluated bathroom designs and options and opted to redesign the restroom and bid the restroom project as a stand-alone project to provide more opportunities for competitive bids. 

On March 17, 2025, the City Council awarded a construction contract to build a new restroom, perform additional site work, ADA walking paths, landscaping, and other related work adjacent to the new restroom. The Council approved a total budget of $1,377,000 to fully fund construction of the restroom, additional construction management, quality assurance, inspection, labor compliance and design support as required by the Project. This would bring a combined total project budget of $14,174,497 for the development of the Vin Scully Centennial Park. 

To date, significant site improvements to the park have been completed, with the exception of the restroom facility, which is expected to be finished by September 2025. After thoughtful consideration, staff is recommending the addition of several new park features and amenities to further enhance the space and better meet the needs of the community. To support this effort, staff is requesting a budget amendment of $800,000 to fund the furnishing and installation of these additional elements. Proposed enhancements include, but are not limited to: shade structures at the playground, enhanced safety lighting, perimeter fencing, dog park amenities, a new monument sign, and other related site improvements. If approved, this additional work would be finished in the Spring of 2026. Staff is currently soliciting bids from contractors and vendors for this work.

Furthermore, this amendment also accounts for extended consultant services provided by Z&K Consultants that were required due to schedule delays and increases in project scope. The original park improvement plans was based on a 240-working-day schedule, with a projected completion in March 2025. However, the revised completion date is now anticipated for September 2025. During the course of the project, the consultant provided additional services not included in the original agreement, such as; coordination of revised utility connections, expanded collaboration with the project architect, supplemental design for landscaping, irrigation, and sports courts, oversight and design support for the expanded dog park, negotiation of multiple contractor change orders, and construction support for the new restroom facility. These changes have resulted in a funding shortfall, and additional funds are needed to complete the project and close out all contracts.

FISCAL IMPACT/SOURCE OF FUNDING:

The currently approved total project budget for the development of the Vin Scully Centennial Park, including the new restroom facility, is $14,174,497. Staff is requesting that the City Council appropriate $800,000 in available, unencumbered Park Acquisition Funds to support this additional work. Approval of this request will increase the total project budget to $14,974,497.
