| SUBJECT: | APPROVE LEASE AGREEMENT WITH HELP FOR BRAIN INJURED CHILDREN, INC.

RECOMMENDATION:
That the City Council approve a new lease agreement with Help for Brain Injured Children, Inc. for the City property located at 981 North Euclid Street.
DISCUSSION:
Since 1980, Help for Brain Injured Children Inc. (HBIC), a local non-profit organization, has occupied the City-owned property at 981 North Euclid Street. Since then, HBIC has utilized this City property as their non-profit organization headquarters, as well as operating The Cleta Harder Developmental School, a certified non-public school. Here, children with developmental disabilities receive one-on-one instruction to teach and develop social skills, motor skills, and academic competency. HBIC employs a certified and trained team of behavior interventionists that are uniquely qualified to teach and support the development of those youth and adults who have different and specific needs that are unable to be met in a public school setting.
The City leases several properties throughout the City to local non-profit groups that provide significant benefits to the La Habra community. This practice allows the City to help support local non-profits by providing low-cost facilities for groups to provide services for the La Habra community. Through this, the City is able to expand the net of social services that can be utilized by the City's residents. Consistent with other facility leases the City has provided to local non-profit groups, the annual rent for this location is proposed to continue at $1.00 per year. The City will be responsible for providing maintenance of exterior landscaping, driveways, curbs, and adjacent streets. HBIC will be responsible to maintain the building in good condition, as well as pay for utilities and insurance.
If approved by City Council, the agreement will have an effective date of September 15, 2025, for a term length of 5 years. HBIC will have the option to extend the lease for three additional 5 year terms provided written notice is delivered to the City 30 days before the expiration date of each term. This request for a lease extension may be denied by City Council by a 4/5ths vote. The total annual lease payment to the City will be $1, due each December 4th for the duration of the agreement and any extensions.

FISCAL IMPACT/SOURCE OF FUNDING:
If approved by Council, HBIC will be responsible to pay the City $1.00 per year as an annual lease payment. The City's cost to maintain the landscaping are included in the General Fund budget, at a cost of approximately $5,000 per year. The other terms and conditions of this lease are consistent with other similar City facility lease agreements with other local non-profit organizations.
