| SUBJECT: | APPROVE A RESOLUTION AND THE ISSUANCE OF A LIVE ENTERTAINMENT USE PERMIT FOR THE LA HABRA 300 BOWL AT 370 EAST WHITTIER BOULEVARD FOR A ONE-YEAR PERIOD

RECOMMENDATION:
That the City Council:
A. Consider and approve the Live Entertainment Use Permit for the La Habra 300 Bowl at 370 East Whittier Boulevard for a one-year period, subject to conditions; and
B. APPROVE AND ADOPT RESOLUTION NO. CC 2025- ___ ENTITLED: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, APPROVING THE LIVE ENTERTAINMENT USE PERMIT FOR 370 EAST WHITTIER BOULEVARD FOR A ONE-YEAR PERIOD, SUBJECT TO CONDITIONS.
DISCUSSION:
The subject property is located on the southwest corner of Whittier Boulevard and Cypress Street, at 370 East Whittier Boulevard (The La Habra 300 Bowl). The property is designated by the General Plan for Corridor Mixed-Use 1 land use and is located within the C-2 (Commercial) Zone and the Mixed Use (MX) Overlay Zone, which implement the Corridor Mixed-Use 1 General Plan Land use designation.
On December 15, 2014, the City Council approved a Live Entertainment Use Permit for the subject property, which allowed live band performances and karaoke for a one-year period. In January 2015, an assault occurred during a live music event held at the subject property, resulting in a response by the La Habra Police Department to maintain public order. On May 18, 2015, the City Council reviewed and modified the Live Entertainment Use Permit for the subject property, adding conditions including requiring increased onsite security and prohibiting live performances. After these changes, on the following dates, the City Council approved Live Entertainment Use Permits for the subject property, limiting the live entertainment to karaoke:

- March 8, 2016
- January 17, 2017
- December 18, 2017
- December 3, 2018
- December 2, 20191
- July 19, 2021
- September 19, 2022
- August 7, 2023
- August 5, 2024
1. Due to the COVID-19 pandemic and the closure of non-essential businesses, the La Habra 300 Bowl was not able to utilize the Live Entertainment Use Permit for a majority of 2020.
Pursuant to La Habra Municipal Code Section 5.32.080, Live Entertainment Use Permits are approved for a one-year period as follows:
“All permits granted pursuant to the provisions of this chapter shall be valid for one year from the date of issuance and will automatically expire, unless renewed, pursuant to the provisions of Section 5.32.085 of this chapter on or before the anniversary date of issuance of the original permit. No permit issued hereunder shall be valid for more than a one-year period of time, nor may the same be assigned or transferred."
At this time the applicant, Catherine Gage, the owner of The La Habra 300 Bowl, is requesting approval of a Live Entertainment Use Permit for a one-year period (September 19, 2025, through September 19, 2026) for karaoke, subject to the same conditions, as previously approved. Staff has reviewed the requested Live Entertainment Use Permit and found no reason to recommend denial. The Police Department is also in agreement and is not opposed to the approval of the request. The attached resolution incorporates all conditions placed on the facility consistent with prior City Council approvals; therefore, it is recommended that the City Council approve the Live Entertainment Use Permit for 370 East Whittier Boulevard for a one-year period, subject to conditions.
FISCAL IMPACT/SOURCE OF FUNDING:
The Applicant has paid for the processing of the Live Entertainment Use Permit totaling $393.
GENERAL PLAN RELEVANCE/CITY COUNCIL GOALS & OBJECTIVES:
The proposed Live Entertainment Use Permit is related to the following General Plan policies:
- LU 4.8 Assembly Facilities. Permit the development of assembly facilities for social, cultural, educational, and religious organizations in locations where they can be located, designed, and managed to assure compatibility with and the safety of adjourning uses.
- LU 11.1 Diversity of Uses. Provide for and encourage the development of a broad range of uses in La Habra’s commercial centers and corridors that reduce the need to travel to adjoining communities, and capture a greater share of local spending.
- ED 1.1 Consumer Demand. Explore opportunities to increase the competitive role of the City’s retail sector to serve both the community and the larger base of consumers in surrounding communities.
The proposed Live Entertainment Use Permit is related to the following City Council Goal and Objective:
- Goal 5 – Development Activity and Business Assistance
- Objective D: Continue to improve the City’s business retention and expansion program.
