| SUBJECT: | APPROVE NOTICE OF COMPLETION FOR VIN SCULLY CENTENNIAL PARK IMPROVEMENT PROJECT, CITY PROJECT NO. 2-P-22

RECOMMENDATION:
That the City Council:
A. Approve the Notice of Completion for Vin Scully Centennial Park Improvement Project, City Project No. 2-P-22, and authorize staff to submit the Notice of Completion for recordation; and
B. Authorize the City Manager to execute an Agreement for Maintenance and Plant Establishment with Legion Contractors, Inc. of Irvine, California, for a 90-day period.
DISCUSSION:
On October 16, 2023, the City Council awarded a construction contract to Legion Contractors, Inc. of Irvine, California in the amount of $10,997,848, which included a ten percent (10%) contingency for the construction of Vin Scully Centennial Park (formerly known as Vista Grande Park). Park amenities include: an open play field, dog park, a walking and running path, exercise stations, asphalt roadways and parking areas, playground equipment, an art wall, a food truck circle, an amphitheater, a drought tolerant demonstration garden, landscaping/irrigation, installation of stormwater drainage basins, tree planting, a gazebo, a volleyball court, pickleball courts, a basketball/futsal court, picnic tables and other amenities. The project also made modifications to the landfill gas control system and the installation of a new landfill cap to meet regulatory agency requirements such as the California Regional Water Board (Santa Ana RWQCB), CalRecycle, and the local environmental enforcement agency (LEA).
Staff conducted a final inspection and found that the work was completed in accordance with the project plans, specifications, and City of La Habra standards. Upon acceptance of the project by the City Council, staff will file a Notice of Completion (Attachment 1) for recordation at the Orange County Clerk-Recorder's Office.
Furthermore, staff request that the City Council authorize the City Manager to execute an Agreement for Maintenance and Plant Establishment for a 90-day period beginning October 22, 2025. The maintenance agreement notes that the contractor will be responsible for replacing any plants that die and any irrigation issues that arise during the course of the 90-day period. The Agreement will withhold $60,000 from retention until the 90-day period has passed.

FISCAL IMPACT/SOURCE OF FUNDING:
The Project has an approved construction budget in the amount of $10,997,848. The total construction cost for Legion's contract was $10,947,688.37; therefore, there are sufficient funds to release retention and file the Notice of Completion.
