CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA):
The project was reviewed pursuant to the guidelines of the California Environmental Quality Act (CEQA) and determined to be categorically exempt pursuant to Section 15304(e), Class 4 (Minor Alterations to Land) of the CEQA Guidelines. Class 4 consists of minor public or private alterations in the conditions of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees except for forestry or agricultural purposes. Class 4 includes minor temporary uses of land having negligible or no permanent effects on the environment including carnivals, sales of Christmas trees, etc. The sites identified for the proposed project are vacant lots with no permanent structures. The project involves the erection of temporary structures only. No removal of vegetation is proposed, and the sites will return to their existing conditions after the event has concluded. The project is also exempt pursuant to Section 15061(b)(3) (Common Sense Exemption) of the CEQA Guidelines in that there is no possibility that the special event may have a significant effect on the environment.
The project is not subject to any of the exceptions for exemption under 15300.2 of the CEQA Guidelines. The location of the project is predominantly urban and not considered a sensitive environment; therefore, the project will not result in any significant impacts that may otherwise occur in a sensitive environmental area. The cumulative impact of this project, and the approval of other projects like it in the vicinity, is not expected to have any significant environmental impact. The project is not located along any state-designated scenic highway nor within any designated hazardous waste site. The project will not cause a substantial adverse change in the significance of any historical resource as the project site consists of vacant lots with no permanent structures. Staff does not expect any significant impacts or unusual circumstances related to the approval and construction of the project. Therefore, the project is categorically exempt from CEQA.

DISCUSSION:
The Applicant, Mark Landon of Trapeze Entertainment, LLC, is requesting the approval of Large Special Event Permit 26-0001 (SEP2L26-0001) to operate a traveling circus (the "Project") on vacant properties owned by 555 Star Development (115 North Harbor Boulevard) and GSJ Stearns LLC (1002-1026 East Stearns Avenue) (collectively, the "Project Site"). As identified in Exhibit 1 and Attachment 2, the main event space would be on the vacant property located on the northwest corner of La Habra and Harbor Boulevards (115 North Harbor Boulevard) and the parking area for the event would be located approximately 500 feet northwest of the event space on the southeast corner of Stearns Avenue and Sunset Street (1002-1026 East Stearns Avenue).

The General Plan designates the Project Site for Mixed-Use Center 3 land use, which is characterized by large parcels developed with a mix of commercial and residential uses to create a semi-urbanized character. The Project Site is also located within the La Habra Boulevard Specific Plan (SP-1) Zone and the Mixed-Use (MX) Overlay Zone, which implements the properties' General Plan Land Use Designation. Pursuant to La Habra Municipal Code (LHMC) Section 18.54.040, the regulations set forth in Chapter 18.54 (Mixed-Use Overlay Zones (MX)) of the LHMC are in addition to the regulations set forth in the base zone (SP-1 Zone). In the event of a conflict between provisions of the MX Overlay Zone and the provisions of the base zone (SP-1 Zone), the provisions of the MX Overlay Zone prevail. If the MX Overlay Zone is silent in relation to any development standard, the development standard identified in the base zone (SP-1 Zone) prevails. A Large Special Event is permitted subject to the approval of a Large Special Event Permit in both the MX Overlay Zone and the SP-1 Zone. Land use information for the Project Site and each of the surrounding properties is summarized in Table 1 below:

LHMC Section 18.04.030 (Terms Defined) defines a "special event" as any organized activity of limited duration on private property or in the public right-of-way which may not meet the normal development or use standards of the applicable zoning district, but may otherwise be acceptable because of the temporary nature of the activity, or which exceeds the scope of the business licensed and approved for the premises on which the event is to be held. Special events may be one-time or recurring. Examples of a special event include, but are not limited to, block parties; sidewalk sales; carnivals, circuses, fairs, festivals and other similar activities; parades; grand openings; and farmers' markets and other seasonal commercial sales. A "Large Special Event" includes any of the following:
- Anticipated to have two hundred fifty or more attendees.
- A duration of five or more days.
- Temporary removal of more than twenty-five percent of the available on-site parking.
- Closure of one or more public street(s).
- Use of an inflatable structure, including, but not limited to, a bounce house, larger than two hundred square feet in size.
Pursuant to LHMC Section 18.65.040.B (Large Special Event Permits), Large Special Events are subject to the approval of the Planning Commission.
The proposed Large Special Event is a traveling circus ("Circus Caballero" or "Circus") that specializes in acrobatics, stunts, and comedy. There are no animals involved in the Circus. Each show is expected to accommodate an average of 300 attendees per performance. The Applicant has secured locations to hold the Circus in Redondo Beach from April 23–May 3, 2026, Bell from May 7–24, 2026, and North Hollywood from May 28–June 14, 2026. The Applicant is proposing to bring the Circus to La Habra from June 18–July 5, 2026. Staff associated with the Circus would arrive on the Project Site to set-up the Circus on June 15, three days before the first scheduled performance. The Circus would need to pass all required inspections in advance of the first performance, which is proposed for June 18 at 7:30 PM. The Circus will hold performances seven days a week at the times identified in Table 2. Tear down and clean-up would occur on July 6. Project Specific Condition of Approval No. 1 of the proposed conditions of approval for the Large Special Event Permit requires the Applicant to adhere to this operating schedule; Project Specific Condition of Approval No. 2 requires the site to be cleaned up and returned to existing conditions no later than July 6, 2026. In addition, the proposed parking area currently has an ongoing code enforcement case relating to overgrown vegetation. Project Specific Condition of Approval No. 14 requires the Applicant to address all code enforcement concerns before set-up for the event begins.

Exhibit 2 and Attachment 3 show the site plan for the main event space. The Circus travels with eight 40-foot RVs which are attached to the show's generator. These RVs are positioned around the main show tent. One of these RVs will be utilized as the ticket sales box office and will be positioned towards the front entrance. Circus Cabellero carries five of its own porta-potties, one of which is Americans with Disabilities Act (ADA) accessible. The Circus also travels with its own 40-yard dumpster, which is hauled by the Circus to an appropriate location for disposal. Trash cans are available for public use outside the tent area, and any trash that falls inside the tent area will be cleaned up by the show crew after each show. The main tent is round with a diameter of 131 feet. Inside the tent is a round performance area with a ring of bleacher seats for attendees to watch the show. The tent has four lighted exits located at various locations around the bleachers. Toward the front of the tent there is an area with a food stand, sinks, dining area, and areas for photo opportunities.

Exhibit 3 and Attachment 4 identify the access route between the main event space and the parking area, which is approximately 500 feet northwest from the main event space. Pedestrian access between the parking area and the main event space is provided via the public sidewalks on East Stearns Avenue and North Harbor Boulevard. Project Specific Condition of Approval No. 8 requires the Applicant to ensure that temporary fencing is installed around the perimeter of the property located at the southwest corner of East Stearns Avenue and North Harbor Boulevard; Project Specific Condition of Approval No. 12 requires security to be provided along the proposed access route from the parking area to the main event area to ensure that attendees are following the approved access route plan without cutting through this private property that is not a part of the special event or owned by either 555 Star Development (115 North Harbor Boulevard) or GSJ Stearns LLC (1002-1026 East Stearns Avenue).

As shown in Exhibit 4 and Attachment 4, vehicles will enter the parking area from East Stearns Avenue. The Engineering Department has reviewed the project proposal and has determined that the event will not create an impact on traffic and no additional traffic impact study or mitigation plan will been needed. To reduce the traffic impact on nearby residential streets Project Specific Condition No. 11 will restrict traffic leaving the event to right turns only, guiding traffic towards Harbor Blvd. The Applicant has proposed to provide 117 parking spaces within this parking area. Project Specific Condition of Approval No. 10 requires parking attendants to be stationed within the parking area to help direct traffic and ensure cars are parked pursuant to the approved parking plan. Ten additional accessible parking spaces are provided on property identified as the main event space.

LHMC Chapter 18.14 (Off-Street Parking Requirements) identifies the parking requirements for temporary commercial enterprises and seasonal commercial sales lots, which includes specific uses such as Christmas tree lots and produce stands; however, the LHMC does not have a specific requirement for Large or Small Special Events. Therefore, as shown in Table 3, staff used the parking requirement for temporary commercial enterprises and seasonal commercial sales lots, which requires a minimum of four parking spaces plus four parking spaces per 1,000 square feet of display area, as a proxy to identify if adequate parking was provided for the proposed Circus.

LHMC Chapter 9.32 (Noise Control) prohibits exterior noise from being above 55 decibels (db) from 7:00 AM-10:00 PM, as measured at the property line. The Applicant has provided noise measurements from other Circus Caballero events to determine the impact that the Circus will have on neighboring residential properties. There are two residential units approximately 100 feet from the main event area, three residential units approximately 150 feet from the main event area and one residential unit approximately 200 feet away from the main event area. During testing done at a previous show location, sound levels were around 54 db at 200 feet from the Circus tent, 60 db at 150 feet, and about 65 db at 100 feet from the Circus tent. Amplified sound will be inside the tent only, during the show times listed in Table 2. In addition to the main event property, there are residences located to the north, south and west of the property that would also be affected by noise from patrons coming to and leaving the event. While the expected noise levels exceed the threshold permitted by the LHMC, the proposed event would have no impact on the surrounding residents. The La Habra General Plan includes a roadway noise contour map which identifies expected ambient noise levels from the existing roadways. In this study it was identified that major corridors, including Harbor Blvd where this event is proposed, generate approximately 60-70 db of ambient noise. With the proposed event sound levels within this same range, the expected noise generated will not exceed the current conditions and no additional noise impact is expected on nearby residents. Project Specific Condition of Approval No. 2 requires the event to comply with the noise ordinance at all times except during the showtimes listed in Table 2.
Pursuant to LHMC Section 18.04.030, the Circus is considered a Large Special Event Permit (SEP) because it is anticipated to have two hundred fifty or more attendees and is planned for a duration of five or more days. Pursuant to LHMC Section 18.65.080, in order to grant the SEP, the Planning Commission must make the findings below. Following each finding, staff has provided justification to make said finding.
1. The proposed site is adequate in size and shape to accommodate such special event without material detriment to the use or enjoyment of the property of other persons located in the vicinity of the site.
The proposed main event area is located on a 78,927 square-foot (1.81 acre) vacant lot with independent vehicle access from both Harbor and La Habra Boulevards. The entire circus area is proposed to cover approximately 32,400 square feet. This area includes the circus tent, RVs, a concession stand, bathrooms, and a ticket booth. In addition, the main event area plus the parking area can accommodate more than the required number of parking spaces required for the event. The proposed event will have minimal impacts on the surrounding uses, as the main event area is primarily surrounded by commercial uses, parking lots, and adjacent vacant lots. The Engineering Department has reviewed the project proposal and has determined that the event will not create an impact on traffic and that no additional traffic impact study or mitigation plan will been needed. Temporary fencing will be set up to ensure that attendees are not utilizing the neighboring property for access from the parking area to the main event space. The Applicant has provided noise studies conducted by the Applicant for other circus shows which demonstrate the circus shows will have little to no noise impact on neighboring residential properties. Shows will also end relatively early, with the latest shows on weekends ending around 9:30 PM. Additionally, due to the proximity of the event space to Harbor Blvd., sound levels are expected to be comparable to the existing conditions, with no expected significant noise impact on the surrounding residences and businesses.
Therefore, the proposed site is adequate in size and shape to accommodate such special event without material detriment to the use or enjoyment of the property of other persons located within the vicinity of the site.
2. Sufficient off-street parking spaces, which may include off-site locations, shuttles, or valet parking, are provided.
The Applicant has provided a parking plan which complies with the minimum parking requirements for special events within the City. Section 18.14.060 (Number of Spaces Required) of the LHMC does not have a specific parking requirement for Large or Small Special Events. Therefore, staff used the parking requirement for temporary commercial enterprises and seasonal commercial sales lots as set forth in LHMC Section 18.14.060, which requires that all temporary commercial enterprises provide a minimum of four parking spaces plus four parking spaces per 1,000 square feet of display area. This calculation requires that the Applicant provide 102 parking spaces for the event. The parking plan provided by the Applicant allows for parking of 117 vehicles in an off-site vacant lot located approximately 500 feet northwest of the main event space, and has provided 10 accessible parking spaces on the same parcel as the main event space for a total of 127 parking spaces.
Therefore, the Applicant has provided sufficient off-street parking spaces.
3. The proposed site is adequately served by streets or highways having sufficient width and improvements to accommodate the kind and quantity of traffic that such special event will or could reasonably generate.
The proposed site is located on the corner of two major thoroughfares within the City, Harbor Blvd. and La Habra Blvd. These streets serve two major commercial corridors within the City and are lined with commercial shopping centers and businesses which have parking lots that can accommodate large quantities of vehicles. Minor residential streets will not be required to access the main event space nor the dedicated parking area. The Engineering Department has reviewed this project proposal and determined that no additional traffic impact study or mitigation plan would be required.
Therefore, the proposed sire is adequately served by streets or highways having sufficient width and improvements to accommodate the kind and quantity of traffic the special event will or could reasonably generate.
4. The proposed activity will not interfere with any other special event for which a permit has already been approved or with the provision of city services in support of other scheduled activities.
There are currently no other approved or proposed special events within the vicinity of this proposed event. There are currently no scheduled City activities at or within the vicinity of this proposed event.
Therefore, the proposed activity will not interfere with any other special event for which a permit has already been approved or with the provision of City services in support of other scheduled activities.
5. The use or event will comply with all applicable provisions of local, state and federal laws and regulations.
The Applicant is aware of all permits needed to operate their event. The Applicant has demonstrated that the special event complies with the provisions of the La Habra Municipal Code and has obtained permit clearance from the OC Health Care Agency for the proposed food sales and permit approval from the Los Angeles County Fire Department for their proposed temporary circus tent structure. The Applicant is aware of the need to apply for a building permit for temporary generators and the need for a City business license and will obtain these before the proposed event start date. While the expected noise levels may exceed the threshold permitted by the LHMC, the proposed event would have no audible impact on the surrounding residents due to the existing ambient noise from Harbor Blvd., which is equivalent to, and at times exceeds, the expected sound levels from the proposed event. Additionally, Standard Condition of Approval No. 1.1 requires compliance with the LHMC and all applicable federal, state and local laws, ordinances, policies and regulations.
Therefore, the event will comply with all applicable provisions of local, state and federal laws and regulations.
6. None of the grounds for denial found in LHMC Section 18.65.090 exist.
Based on the information provided by the Applicant and available to staff, none of the grounds for denial found in LHMC Section 18.65.090 exist. The information contained within the application was found to be complete and not found to be materially false. This entitlement is the Applicant's first special event permit application within the City, therefore, the Applicant has not failed to conduct a previously authorized activity in accordance with the law or terms of the permit. The Applicant has no outstanding or unpaid debts to the City. The Applicant has completed the indemnification and hold harmless requirement prescribed by LHMC Chapter 18.65. This is the Applicant's first special event application; therefore, no previous special event permits have been issued to the Applicant for which the Applicant violated any conditions of the permit. Finally, the Applicant has not violated any City ordinance, rule, or regulation within the past twenty-four months.
Therefore, none of the grounds for denial found in LHMC Section 18.65.090 exist.
FISCAL IMPACT/SOURCE OF FUNDING:
The Applicant has paid for the processing costs associated with a Special Event Permit (Large), which total $517.00.
NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES):
The Applicant's proposal has been reviewed pursuant to the requirements of the City's National Pollutant Discharge Elimination System (NPDES) Municipal Permit, the Local Implementation Plan (LIP), and the Model Water Quality Management Plan (WQMP), Section 7.2. Since no disturbance of soil will occur, the project is exempted by the Water Quality Ordinance from the preparation of a WQMP.
GENERAL PLAN RELEVANCE/CITY COUNCIL GOALS & OBJECTIVES:
The proposed special event is related to the following General Plan policies:
- CI 6.1 Calendar of Events. Administer and partner with local organizations in the conduct of an annual program of events and celebrations that offer opportunities for residents to gather, recreate, and appreciate life in La Habra.
- OS 3.5 Community Special Events. Support and encourage community wide special events that incorporate and promote the City's history, family activities, cultural events, and educational opportunities.
- Goal 5 - Development Activity and Business Assistance
- Objective C: Work closely with commercial and residential property owners to improve and maintain the appearance of their properties.
- Objective D: Continue to improve the City's business retention and expansion program.
- Objective E: Continue to evaluate and improve the City's development review process and continue to foster a "business friendly" environment within all City departments.
