| SUBJECT: | CONSIDER AN ORDINANCE AMENDING CHAPTER 1.16 TO TITLE 1 OF THE LA HABRA MUNICIPAL CODE RELATING TO THE CITY'S OFFICIAL SEAL AND CITY LOGO |
RECOMMENDATION:
That the City Council:
A. APPROVE THE FIRST READING OF ORDINANCE NO._______ ENTITLED: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA HABRA, AMENDING CHAPTER 1.16 ("CITY SEAL") TO TITLE 1 ("GENERAL PROVISIONS") OF THE LA HABRA MUNICIPAL CODE RELATING TO THE CITY SEAL AND CITY LOGOS; and
B. Authorize the City Manager, or his/her designee, to approve or deny requests from third parties who request official use the City seal and/or logo.
DISCUSSION:
On February 3, 1925, the City Council adopted Ordinance No. 1 entitled "An Ordinance of the City of La Habra Fixing the Time and Place of Meetings of the Board of Trustees Thereof, and Providing for a Common Seal." On November 1, 2010, the City Council formally adopted the currently used decorative City logo and several alternate logos that are often seen on City letterhead, stationary, business cards, marketing materials, program advertisements, websites, social media accounts, and on other official communication from the City. When taking these actions; however, the City Council did not specifically prohibit the unauthorized use of the City’s official seal and logos (both past and present) as part of the City's municipal code.
While the City does have a policy on the proper use of the City’s seal and logos (Policy No. 5.80; June 1, 2005, Attachment 1), the policy does not have the force of law and; therefore, cannot be enforced under the City’s general authority to enforce its regulations that are adopted by ordinance.
To address this, staff recommends that the unauthorized use of the City's seal and logos (both past and present), be prohibited by ordinance. This action provides enhanced legal protection against the unauthorized use of the City seal and logos by third parties. In addition, staff recommends that the City Council authorize the City Manager, or his/her designee, to consider and approve or deny requests from third parties who request to use the City seal and/or logo to promote and/or advertise co-sponsored public events or programs.

FISCAL IMPACT/SOURCE OF FUNDING:
There is no fiscal impact associated with this action.

CI 3.1 Sense of Community - Establish a common logo and design template that will be consistently used for signage of public right-of-ways, places, and buildings.
