RECOMMENDATION:
That City Council:
APPROVE THE FIRST READING OF ORDINANCE NO. ______ ENTITLED: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA HABRA AMENDING SECTION 2.12.010 (“ELECTION”) OF CHAPTER 2.12 (“MAYOR AND MAYOR PRO TEM”) TO TITLE 2 (“ADMINISTRATION AND ORGANIZATION”) OF THE LA HABRA MUNICIPAL CODE PERTAINING TO THE ELECTION OF THE MAYOR AND MAYOR PRO TEM.
DISCUSSION:
La Habra Municipal Code Chapter 2.12 ("Mayor and Mayor Pro Tem") of TItle 2 ("Administration and Organization") addresses the annual City Council election of Mayor and Mayor Pro Tem and provides that "Such election shall occur on the first Monday of each December or in the event of election years, it shall occur at such council meeting as the newly elected council members are sworn in, whichever shall occur last."
During election years, the Orange Council Registrar of Voters has up to 30 days to provide the City Clerk with the Certificate of Election, which can occur after the first Monday in December. When this occurs, it causes a delay of election of Mayor and Mayor Pro Tem until the second City Council meeting in December, resulting in two-week longer terms for the then serving Mayor and Mayor Pro Tem.
In order to provide consistency with the annual time served as Mayor and Mayor Pro Tem, staff recommends that the La Habra Muncipal Code Section 2.12 ("Mayor and Mayor Pro Tem") to Title 2 ("Administration and Organization") be amended so that the election of Mayor and Mayor Pro Tem be held at the second Council meeting each December, which would be scheduled on the third Monday of that month.
