| SUBJECT: | APPROVE NOTICE OF COMPLETION FOR THE LA HABRA SPLASH PADS AT BRIO PARK AND OESTE PARK, CITY PROJECT NO. 3-P-19 |
RECOMMENDATION:
That the City Council approve the Notice of Completion for the La Habra Splash Pads at Brio Park and Oeste Park, City Project No. 3-P-19; and authorize staff to send for recordation.
DISCUSSION:
On October 21, 2019, the City Council awarded a contract to C.S. Legacy Construction Inc., of Chino, California, in the amount of $2,372,484, which included a 10 percent contingency for the construction of two splash pads, one at Brio Park and one at Oeste Park, which included water features, pump equipment, outdoor showers, equipment enclosures, seating walls, removal and relocation of trees, landscaping and irrigation improvements, installation of security lighting and a perimeter fencing, and shade sail canopies
All improvements associated with the above-mentioned Project have been completed. Staff conducted a final inspection and found the work to be satisfactory and in compliance with project plans, specifications, and standards. Upon acceptance of the project by the City Council, staff will file a Notice of Completion for recordation at the County Recorder’s Office. A copy of the Notice of Completion is included as Attachment 1. "Before and After" pictures are included as Attachment 2.

FISCAL IMPACT/SOURCE OF FUNDING:
The final cost of construction for the Project is $2,239,630.75, which is six percent less than the approved purchase order amount of $2,372,484. There are sufficient funds to cover the cost of the Project.
It should be noted that the general contractor, C.S. Legacy Construction, Inc., has filed a lawsuit against the City claiming it is owed $703,353.34, which the City has denied. The City has, in turn, filed a cross-complaint against C.S. Legacy Construction, Inc. The final contract payment amount will be determined at a later date, pending the resolution of the litigation with C.S. Legacy Construction, Inc. A five percent retention will be held in escrow pending outcome of the litigation.
