| SUBJECT: | APPROVE DENIAL OF LIABILITY CLAIM OF MR. WILLIAM SCOTTEN FOR PROPERTY DAMAGE |
RECOMMENDATION:
That the City Council approve the claim of Mr. William Scotten be denied in order to set a definite six-month Statute of Limitations date.
DISCUSSION:
On June 10, 2020, Mr. William Scotten, a La Habra Heights resident, filed a property damage claim in the amount of $40,000. The claim alleges that, on January 19, 2020, while driving home from work, he was hit by a speeding vehicle that was being pursued by the La Habra Police Department. The incident, which occurred at the intersection of Whittier Boulevard and Painter Avenue in the City of Whittier, involved a suspect traveling at a high rate of speed who collided into the claimant’s vehicle causing damage to his vehicle. The claimant alleges that the cause of the collision was due to La Habra Police Officers pursing the suspect's vehicle at a high rate of speed.
