APPROVE A RESOLUTION AND THE ISSUANCE OF A LIVE ENTERTAINMENT PERMIT FOR 370 EAST WHITTIER BOULEVARD FOR A ONE-YEAR PERIOD

RECOMMENDATION:


That the City Council:
A.  Consider and approve the Live Entertainment Permit for 370 East Whittier Boulevard for a one-year period, subject to conditions; and

B.  APPROVE AND ADOPT RESOLUTION NO. ______ ENTITLED:  A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, APPROVING THE LIVE ENTERTAINMENT PERMIT FOR 370 EAST WHITTIER BOULEVARD FOR A ONE-YEAR PERIOD, SUBJECT TO CONDITIONS.

DISCUSSION:

The subject site, La Habra 300 Bowl, is located on the southwest corner of Whittier Boulevard and Cypress Street, at 370 East Whittier Boulevard.  The General Plan Land Use designation for the site is “Corridor Mixed-Use 1” and is zoned C-2 (Commercial), which is consistent with the General Plan (see Vicinity Map, Attachment 3).  On December 15, 2014, the City Council approved a Live Entertainment Permit for a one-year period, which allowed live band performances and karaoke.  In January 2015, an assault occurred during a live music event at the site, resulting in a response by the La Habra Police Department to maintain public order.  Accordingly, on May 18, 2015, the City Council reviewed and modified the Live Entertainment Permit for La Habra 300 Bowl, adding conditions that required an increase of onsite security and removed approval for live performances.
 
 

Subsequently, the City Council approved Live Entertainment Permits for karaoke for one-year periods on March 8, 2016, on January 17, 2017, on December 18, 2017, on December 3, 2018, and on December 2, 2019.  However, due to the COVID-19 pandemic and mandatory business closures, the bowling alley was not able to utilize the Live Entertainment Permit for the majority of 2020 and has waited until now to reapply for the new permit to coincide with the State's gradual loosening of restrictions on these types of businesses.

Since 2016 the entertainment permits granted by the City have been for a period coinciding with the calendar year (i.e., January 1 through December 31); however, pursuant to Section 5.32.080 of the La Habra Municipal Code, these permits are approved for a one-year period as follows:
 
All permits granted pursuant to the provisions of this chapter shall be valid for one year from the date of issuance and will automatically expire, unless renewed, pursuant to the provisions of Section 5.32.085 of this chapter on or before the anniversary date of issuance of the original permit. No permit issued hereunder shall be valid for more than a one-year period of time, nor may the same be assigned or transferred.

At this time, the Applicant is requesting approval of a Live Entertainment Permit for a one-year period and for karaoke, as was previously approved in 2017.  

Staff reviewed the requested Live Entertainment Permit and found no reason to recommend denial.  Specifically, the Police Department has had no significant calls for service and is not opposed to the approval of the request subject to the same conditions being placed on the facility.  The proposed resolution incorporates all conditions placed on the facility consistent with prior City Council approvals; therefore, it is recommended that the City Council approve the Live Entertainment Permit for 370 East Whittier Boulevard for a one-year period, subject to conditions.

FISCAL IMPACT/SOURCE OF FUNDING:

There is no fiscal impact to the City's General Fund.
