RECOMMENDATION:
That the City Council deny the claim of Mr. Jerry Apodaca in order to set a definite six-month Statute of Limitations date.
DISCUSSION:
The City received a property damage claim from Mr. Jerry Apodaca, a resident of La Habra Heights, on August 2, 2021. The claim, which is in the amount of $2,600, alleges a dangerous condition of public property. In his claim, Mr. Apodaca states that at approximately 10:00 p.m. on July 9, 2021, he was traveling in his vehicle eastbound on Imperial Highway, approaching Euclid Street, when he struck the center median causing damage to the left front tire and rear tire and rim of his vehicle. The location of the alleged incident is under the jurisdictional control of CalTrans. Mr. Apodaca alleges the center median is placed too far in the middle of the left lane, causing a dangerous condition.
