APPROVE A QUITCLAIM DEED FOR THE VACATION OF A PUBLIC WATERLINE EASEMENT LOCATED AT 555 SOUTH HARBOR BOULEVARD

RECOMMENDATION:


That the City Council APPROVE AND ADOPT RESOLUTION NO. _____ ENTITLED:  A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA HABRA, CALIFORNIA, APPROVING A QUITCLAIM DEED TO VACATE PORTION OF THE NORTHERLY 248 FEET OF AN EXISTING 300-FOOT CITY OF LA HABRA EASEMENT LOCATED AT 555 SOUTH HARBOR BOULEVARD, ASSESSOR’S PARCEL NUMBERS 298-161-03 AND 298-161-11, AS DESCRIBED IN EXHIBIT “A” AND EXHIBIT “B."

DISCUSSION:

In 2021, the property at 555 South Harbor Boulevard was redeveloped, and a package transfer facility was constructed at this location.  The design of this facility required the relocation of a public water line and a fire hydrant.  Because the new waterline for the project was constructed outside the existing utility easement, a large portion of the 300-foot easement within the property is no longer needed; therefore, it would be appropriate for the City to vacate this section of easement through a quitclaim deed.

The southerly 52 feet of the entire 300-foot existing waterline within the easement will continue to serve the property, and if approved, the remaining 248 foot-easement will be quitclaimed, pursuant to Sections 18330-8363 of the Streets and Highways Code.
