| SUBJECT: | APPROVE DENIAL OF LIABILITY CLAIM OF MERCURY INSURANCE FOR PROPERTY DAMAGE

RECOMMENDATION:
That the City Council deny the claim of Mercury Insurance in order to set a definite six-month Statute of Limitations date.
DISCUSSION:
On February 15, 2022, Mercury Insurance filed a property damage claim on behalf of their insured, Eun Namkung (a City of La Habra resident), in the amount of $858.56 for damages to Mr. Namkung’s vehicle. The claim alleges that, on October 5, 2021, their insured’s vehicle was parked at 1230 West Imperial Highway (T.J. Maxx parking lot), when a City-owned tree branch fell on their insured’s vehicle causing damage to the trim of the windshield of the vehicle. The property where the alleged incident took place is not owned or maintained by the City of La Habra; therefore, the City is not liable for this claim.
